Sub:- Transfer on deputation/foreign service – applicability of DOP&T’s OM dated 30.11.2012 on Railway Employees who have been promoted to higher post in cadre while on deputation through 70% Selection- regarding.
Instructions regarding grant of benefit of proforma promotion under NBR to the Railway officials have been consolidated & circulated to all the Railways vide Board’s letter No. F(E)I/2018/3(4)/1 dated 28.12.2018 (RBE No. 203/2018). As per Para (i) of DoP&T’s O.M. No. 6/5/2012-Estt. (Pay-II) dated 30.11.2012 enclosed with the above Board’s letter, in case of candidates who have passed the Limited Departmental Competitive Exam (LDCE) and whose names have been recommended for promotion, proforma promotions may be allowed from the date their juniors in the cadre in the order of merit in the LDCE have been so promoted.

In this regard, few individual cases of Group ‘C’ employees of organized railway services have been forwarded by the concerned zonal Railways to Board seeking advice as to whether such employees, who are away from the cadre on deputation and approved for promotion to Group ‘B’ through 70% Selection can be considered for grant of proforma promotion under NBR in terms of DOP&T’s above OM dt. 30.11.2012 as is being given to those selected through 30% LDCE.
3. The issue has been examined in consultation with the nodal directorate for promotion of group ‘C’ to group ‘B’ Railway employees i,e. Management Services {E(GP)} Directorate, the nodal department i.e. DoP&T, Department of Expenditure and with the approval of Board(CRB&CEO), it is clarified that, since, while considering cases of promotion of group ‘C’ employees of organized railway services to group ‘B’, the method followed in 70% by promotion through selection is akin to LDCE, the instructions issued by DOP&T vide para (i) of the O.M. No. 6/5/2012-Estt.(Pay-II) dated 30.11.2012 adopted vide Board’s letter No. 2010/F(E)I/I)/1 dated 28.06.2013, will also be applicable to such cases of Railway employees who are away from the cadre on deputation and approved for promotion to Group ‘B’ through 70% Selection, subject to fulfillment of all other conditions stipulated under Next Below Rule (FR-22).
