Decentralization of Prosecution Cadre at par with other miscellaneous cadres on Zonal Railways: Railway Board Order dated 06.06.2024

Sub.: Decentralization of Prosecution Cadre at par with other miscellaneous cadres on Zonal Railways.

In terms of Board’s order No. 2012 E(GC) 13-2 dated 12.06.2019, a separate Prosecution Cadre has been formed on the Railways after separation from the Railway Protection Force. However, pending finalization of Recruitment Rules for promotions In the Prosecution Cadre, the procedure for initial selection to Group ‘B’ posts of Senior Public Prosecutors in Level-8 of the Pay Matrix was inter alia outlined in Board’s letters No. E(GP)2019/2/14 dated 21.10.2019 and No. 2022/Prosecution Cell/Cdr./01 dated 20.04.2022.

2. The Recruitment Rules for Prosecution Cadre have since been notified vide GSR 518 (E) dated 04.07.2022 (F.No. 2014/E(G)RR/22/2) and Board’s letter No. E(NG)IV2021/RR-1/2 dated 06.08.2021. In this regard, it has been decided by the Board to decentralize the Prosecution Cadre and bring it at par with other miscellaneous cadres on Zonal Railways. Accordingly. henceforth the matters relating to Prosecution Cadre shall be dealt with as mentioned below:

i. Direct recruitment of Public Prosecutors (Group ‘C’) and promotion to the posts of Senior Public Prosecutor (Group ‘B’) shall be done by the concerned Zones.
ii. All postings and preparation of seniority lists of Group ‘C’ and Group ‘B posts in the cadre shall be done Zone-wise.
iii. Transfers in Group ‘C’ shall be carried out by the concerned Zones in terms of instructions issued by E(NG).
iv. Transfers of Gazetted officers in the cadre shall be carried out by the Secretary Directorate.
v. The policy issues of the cadre shall be dealt with by Prosecution Cell in Board’s office.

3. However, as a one-time measure, the existing Public Prosecutors and Senior Public Prosecutors may give an option to the Prosecution Cell in Board’s office for inter-zonal transfer, duly forwarded by the concerned Railway, within one month from the date of issue of this letter.
