At the beginning of meeting of JCM, Mr. A.S. Mazumdar, President, AIKVTA welcome the Chairperson on behalf of Members of staff side. The following members were elected as Leader & Secretary, JCM unanimously as per the provision of JCM as laid down in the Education Code for KVs:-

Stepping up of pay to bring seniors at par with juniors who draw more pay than the seniors, both direct recruits as well as promotes.

Comments of KVS

KVS vide its circular No. F. 110239/58/KVS ( Budget) Dated 20.07.2012 has issued necessary clarification wherein it has been clarified that the stepping up of pay of promote senior with reference to direct recruited junior appointed after 01.01.2006 is permissible.

Decision/Recommendation

Since the appropriate orders have been issued the matter stands resolved/closed.

2. Transfer of Yoga Teachers with post to +2 Vidyalaya in station of choice.

Comments of KVS

Since the post of Yoga teacher is a dying cadre the matter of transferring of the Yoga Teachers along with post as a one time measure to their choice places is under active consideration.

Decision/ Recommendation

The KVS has already started taking steps in the matter, thus stands resolved.

3. Reduction of work load on teachers by reducing (restoring) the weekly number of periods to 30/33/36 for PGT/TGT/PRT as well as fixing the teacher student ratio at 1:25.

Comments of KVS

Reduction of work load on teachers by reducing (restoring) the weekly number of periods is under review. However, the lunch break has been increased from 20 minutes to 30 minutes in recent past.

Decision/Recommendation

The President of AIKVTA put forth the demand of association of re-storing the periods to 30/33/36. After due deliberation it was decided that Commissioner, KVS will constitute a committee which will examine the

matter. The Committee will submit its report within the preview of RTE 2009, within 03 months, from the date of circulation of the minutes.

4. Special recruitments for NE region and Hard and Very Hard Stations.

Comments of KVS

The Board of Governors  in its 90th meeting held on 30.8.2011 has approved to include Central Universities of North-Eastern Regions for the purpose of Campus interview for employment in Kendriya Vidyalaya Sangathan to the post of PGTs with the condition that the candidates so Selected shall serve in that region for a period at least 10 years.

Decision/ Recommendation

The Commissioner, KVS informed the council that for the purpose of ensuring availability of teaching and non teaching staff in Kendriya Vidyalayas located in NE. Region and Hard/Very hard stations, KVS is already considering the proposal for Zonal recruitments although with all India transfer liability. Hence resolved.

5. Reintroduction of transfers against no taker vacancy and mutual transfers.

Comments of KVS

The exercise of effecting transfers against no taker vacancy and mutual vacacy and mutual transters have been discontinued to minimize Administrative work load as well as to avoid the misuse of sanctity of the transfer guidelines as it was noticed that teachers were applying for mutual transfers to break their station seniority and they were coming to their choice station regularly by depriving the needy teachers even after completion of their tenure in hard/very hard station.

In so far as the issue of transfer against No taker vacancy the work load is increased many folds and this was operated earlier throughout the year which affected the studies of students. As most of them were asking 5 to 8 times transfers against No taker vacancies either to break station seniority or to avoid posting to KVs in hard/Very hard/NE stations. The genuine claim of actual contenders were got affected even after completion of their tenure in hard/very hard station. Hence, these transfers are discontinued in the interest of KVS.

Decision/Recommendation

The Commissioner, KVS inform that KVS is already issuing transfers within the framed guidelines which are flexible and has not banned transfer against no taker vacancy. However, the needy/genuine cases are being accommodated against available vacancies. As regards to KVS spouse cases the matter will be reviewed as per the requirement as situation arise from time to time. However mutual transfers are not feasible for administrative convenience.

6. Teacher’s representations on Academic Advisory Committee.

Comments of KVS

The Academic Advisory Committee include besides other members, educationists having good and first-hand experience of school education. In the present Academic Adcisory Committee a Principal of Kendriya Vidyalaya has also been included as a member.

Decision/Recommendation

Although it was stressed that there is no need of introduction of teacher representative in Academic Adisory Committee, the Chairperson was of the view that KVS may explore the possibility for teachers representation in AAC apart from Principal. The Commissioner, KVS may constitute a Committee which will submit its report within 03 months from the date of circulation of the minutes.

7. Sanction of post of Sub-Staff for Vidyalaya Library & Computer Labortory.

Comments of KVS Decision/Recommendation

The matter is being examined.

Will be reviewed in the next meeting.

8. Removal of anomaly in determining the minimum pay and consequential stepping up of pay for PGTs.

KVS vide its circular No. F. 110239/58/KVS (Budget) Dated 20.07.2012 has issued necessary clarification wherein it has been clarified that the stepping up of pay of promote e senior with reference to direct recruited junior appointing after 01.01.2006 is permissible.

Since the orders have been issued the matter stands resolved.

AIKVTA (B) Item No.

1. Points submitted by AIKVTA

Restoration of AIKVTA representation on KVS granted in 2003 was again withdrawn in 2004. HRD standing committee(DEPARTMENT RELATED PARLIAMENTARY STADING COMMITTEE ON HUMAN RESOURCE DEVELOPMENT, HUNDRED SIXTY-SECOND REPORT ON FUNCTIONING OF KENDRIYA VIDYALAYAS) (PRESENTED TO THE RAJYA SABHA ON 28TH APRIL,2005) recommended for representation of Teachers Association on KVS BOG for better functioning of KVS which is yet to be implemented. AIKVTA is the only recognized Association representing KV Teachers hence deserve representation on KVS Board of Governors.

Comments of KVS

In the follow up action to the recommendations of the Parliamentary. Standing Committee, it was conveyed that in BOG of KVS Educationist have already been given proper representation and as such the induction of teachers representatives in BOG of KVS is not desirable. The representatives of teachers associations are having adequate opportunities to contribute to contribute significantly in putting forth the matters of teachers welfare.

Thus, there is no need for nomination of the members of Teaching Association in the BOG of KVS.

Decision/Recommendation

After due deliberation the Chairperson was of the view that although the JCM is the right platform to contribute for the welfare of staff as well as organization. The possibility may be explored whatever the teachers representation is required in BOG.

2. Enhancement of super-annuation retirement age of KV teachers to be t par with retirement age of University teachers:-

The superannuation age of University teachers has been enhanced to 65 years and that of the teachers working under NCT Delhi Administration have been enhanced to 62 years. The demand for enhanced superannuation age of KV teachers was approved by the KVS BOG albeit alongwith such proposal for employees of KVS as a whole, MHRD did not approve the proposal forwarded by KVS. Thus KVS tricked the KV teachers by forwarding the approval of BOG for enhancement of superannuation age of all employees of KVS (not specifically for KV teachers) which has no precedence for age enhancement in any other department under GOI. KVs are struggling for filling the vacancies of teachers and quality teachers with vast experience may immensely benefit KV students simultaneously as KVS may gain financially if good numbers of teachers who are due for retirement in coming two years are retained. Retirement age of KV teachers should be enhanced to 65 years as has been done for University teachers.

Comments of KVS

The matter pertaining to enhancement of retirement age of KVS teaching and Non-teaching category of employees from 60 to 62 years was placed before the Board of Governors, KVS in its 82nd meeting held on 19.02.2009. Thereafter, KVS vide its letter dated 21.04.2009 mooted a proposal to the MHRD to consider the enhancement of retirement age of the employees of KVS from 60 to 62 years. The MHRD after examining of the proposal of KVS, vide their letter dated 27-05-2009 has communicated that there is no need to introduce any variations in retirement age between KVS employees and Central Govt. employees.

As regards, the claim of the assosciation of stated enhancement of retirement age of NCT of Delhi teachers from 60 to 62 years, from the papers submitted by the association it may be ascertained that the NCT of Delhi has reportedly permitted the re-employment of teachers upto the age of 62 years. The association thus, may submit the fully convincing supporting documents in favour of their claim of enhancement of retirement age of teachers under NCT of Delhi and other similar organizations. KVS would take up the matter with the Governing Ministry soon after JCM.

Decision/Recommendation

After detailed deliberation on the matter from both sides the Chairperson decided that no parity can be held between the University teachers and KV teachers as well. Also it cannot be compared with other State Government teaching employees. Hence the demand of association does not appear to be acceptable.

3. Review and formulation of a reasonably lasting Transfer policy that conform to GOI guide lines:-

KVS transfer policy changed about four times during guiding the years. This it self shows that there is no policy guiding the transfer of personnel in KVS. That apart KVS often ignores the DOPT guidelines on transfer policies teachers including ladies and other spouse cases are worst victims of the existing transfer policy alongwith the teachers serving in Hard/Very Hard stations who could not be transferred to their choice stations in spite of completion of defined tenure in hard stations. Even in fixing the tenure in hard stations and very hard stations KVS ignored the criteria fixed by DOPT (GOI). There have been scores of instances where ladies including spouse cases have been transferred to NE Region and Naxal infested area without any concern for their safety and difficulty.

The transfer policy is corollary to recruitment policy. KVS should take the leaf out of recruitment policy of NVS where attempts have been made recruit teachers on state/region basis, thus minimizing the requirement of inter-region transfers. The letter from NVS that streamlined the recruitment policy which in turn reduced the transferability of teachers is given below

Comments of KVS

Since KVS is a big organization and its Kendriya Vidyalaya are spread out all over India including hard/very hard station/J&Ketc., the transfer policy of KVS may not be made at par with Govt. of India’s transfer policy. However, due weightage has been given to elements which are given below to effect the transfer in far and transparent manner as per the requirement of the employees of KVS. The existing transfer guideline are framed with due deliberation applicable to the staff of KVS. The elements are as under:-

1. Spouse, if a KVS employee and posted at the same station has been allotted -15 points to avoid from being displacement and +15 [points for seeking request transfer, if spouse is working at the requested station or within 100 kms.

2. Spouse, if working in Govt. Sector and posted at the same station has been allotted -10 points to avoid from being displacement and +10 points for seeking request transfer if spouse is working at the requested station or within 100 kms.

3. Physically challenged employees have been allotted -50 points to avoid from being displacement and +40 points for seeking request transfers.

4. Women employee have been allotted -10 points to lower down their displacement counts from being displacement and +10 points for seeking request transfers to increase their transfer counts.

5. Members of recognized association of KVS staff who are members of JCM at KVS. Regional Offices and/or KVS (HQ) have been allotted -15 points to avoid from being displacement.

Decision/Recommendation

The Staff side raised the issue that about 25% of spouses are not getting the desired place of posting hence not satisfied with the transfers made by KVS. In reply KVS informed that the transfer policy is safely transparent. All such spouse cases have been considered and adjusted as far as possible. Since certain special provisions are available in KVS transfer policy, such inpidual case shall be considered on receipt of representation.

More so as regards to tenure of employees in North East and Hard and Very Hard Stations the staff side insisted that there is tenure of posting of two years in Govt. Departments instead of three years as is in KVS, who have been transferred to these stations after 10 years of service. The Staff side was directed to produce the copy of Government of India’s order in this regard to KVS to re-look into such cases.

4. Restoration of 10 days Earned leave along with 20 days half pay leave for teachers:-

GOI has restored the provision of 20 days Half Pay Leave (P A) for teachers (Who are vocational staff) as per recommendations of 6th CPC. However, simultaneously the earlier provision of 10 days Earned Leave p.a has been withdrawn. This has terminated a facility granted to teachers after long struggle. 10 days E.L should be granted to KV teachers alongwith 20 days HPL as per recommendations of 6 CPC or at least it should be restored as was earlier t 6th CPC.

Comments of KVS

KVS is an autonomous organisation under Ministry of HRD, Govt. of India, the Govt. of India and the Govt. of India Rules as framed time to time through various Pay Commissions etc. These rules are extendable to its employees mutatis-mutandis.

The present order is based on GOI circular No.13013/2/2008-Estt. (L) Dated 11th November, 2008 issued on the recommendations of 6th CPC. Hence, restoration of 10 days EL alongwith 20 days HPL p.a. for teachers is not feasible as per CCS (Leave) Rules.

Decision/Recommendation

The order is issued based on recommendations of 6th Pay Commission; hence the demand for restoration of 10 days Earned Leave is addition to 20 days HPL was not accepted.

5. Introduction of 5 days week in KVS:-

5 days week should also be implemented in KVs which may give space for students to pursue self learning as per their aptitude and interest. Keeping them bound to school routine six days a week is determined to their natural growth of talent in vaious fields. While Western system of Education is quoted and applauded in ways, this important aspect of giving autounomy to students to pursue their hobbies and interests away form Vidyalaya binding is overlooked. In the interest of over burdened KV teachersw also 5 day week should be introduced in Vidyalayas as has been in force for KVS HQ and Regional offices.

Comments of KVS

The proposal for introduction 5 days week on KVs was discussed in KVS Academic Advisory Committee in detail. The Committee did not approve the proposal, keeping in view the Right to Education Act-2009 which stipulated additionalworking hours for the teachers. As such five days week was not found suitable at this moments.

Decision/Recommendation

In view of impliementation of RTE 2009 it is not possible at present. However, the matter regarding working hours is already sub-judice. The President, AIKVTA informed that there are so many other institutions who are observing 05 days week. The Chariperson, JCM directed him to submit the details with supporting documents of such institutions who ar imparting the school education, observing 05 days week.

6. Review of departmental promotion policy for teaching cadre, with AIKVTA representation on any such review committee:-

Deparmental promotion for teachers in KVS is a myth, not available to senior teacher enen with 15 to 20 years of experience in the Grade. The reason being the introduction of selection promotion policy in place of non selection promotion policy which was in force earlier. We do not have problem with selection promotion policy as long as the tests conducted to evaluate the suitability of teachers in the higher post is limited to a qualifying cut marks rather than a as per merit list position. Written test may serve the limited purpose of evaluating the contenet knowledge of the examinees but can not evaluate the teaching techniques and effectiveness but can not evaluate the teaching techniques and effectiveness of teaching in a class room situation. Senior teachers by virtue of their experience prove to be better teachers than “more informed on content” teachers. Hence promotion policy should be modified to accommodate both the experience and content knowledge by fixing a suitable cut mark in the tests so that those who clear that cut marks may get promotion as per seniority. Even id KVS might have undertaken some review of promotion policy, but AIKVTA was not invited to put forth its views before it. Hence, KVS should reconsider review of promotion policy in the light of AIKVTA view points & with AIKVTA participation in any such endeavour.

Comments of KVS

The representations of the AIKVTA have been examined by the Committee constituted for the revision of Recruitment Rules for various cadres in Kendriya Vidyalaya Sangathan, but the committee has not acceded to the promotional policy of PGTs/TGTs as well as TGT(Misc). However existing scheme of Limited Deptt. Examination has been recommended by the Committee. The recommendations of the committee for the revision of Recruitment Rules for Teaching staff has been approved by the Board of Governors in its 92nd meeting held on 18.5.2012 and notified on 13.7.2012.

Decision/Recommendation

After due deliberation it has been decided that the association (AIKVTA) will submit a detailed proposal separately withing 30 days from the date of receipt of the minutes for further examination of KVS.

7. Promotional avenues for TGTs(WET/PT/ARTS/Sans)&Librarian by introducing additional subjects in + 2 Classess and TGT grade to Music Teachers:-

TGTs (W.E.R,P.E.T,ART) and Librarians do not have promotional avenues and KVS should introduce additional elective subjects at plus to level in those subjects to facilitate creation of PFT posts and facilitate promotion of those teachers.

Music teachers are the most neglected of the staff serving theKendriya Vidyalayas. The essential qualification prescribed for recruitment to the post of Music Teacher corresponds to TGTs, but they are given PRT post. They train secondary and higher secondary students for all sorts of cultural functions held in the Vidyalaya, for Social Science exhibitions, Annual day celebration, to welcome and entertain VIPs visiting the Vidyalayas apart from taking regular period in Primary Classess. In NCT Delhi Schools and many other Govt. School they ar given TGT grade but KVS put them in Primary Scale. It is not exaggeration of facts if we say the Music Teachers in KVS are illegally exploited, they draw the salary of PRT grade and we are compelled to work with secondary and higher secondary students.

Comments of KVS

The representations of the AIKVTA have been examined by the Committee constituted for the revision of Recruitment Rules for various cadres in Kendriya Vidyalaya Sangathan, but the committee has not acceded to the promotional policy in respect of TGT (Misc), however existing scheme of Limited Deptt. Examination has been recommended by the Committee. The recommendations of the committee for the revision of Recruitment Rules for Teaching staff has been approved by the Board of Governors in its 92nd meeting held on 18.5.2012 and notified on 13.7.2012.

Decision/Recommendation

The matter may be reviewed by forming a committee by KVS within 03 months from the date of issue of minutes.

8. Grant of higher pay scale and providing other incentive to KV teachers as per decision taken in 80th meeting of BOG & Grant of Higher Grade Pay, Rs.4600/- to PRT’s at stage 1 and so on:-

The 80th BOG discussed and unanimously decided to grant Higher pay scale and other incentives to KV teachers who are highly qualified and talented. A committee was also set under the Chairmanship of Vice-Chairman, KVS to examine the proposal for granting higher pay scale and other incentives to KV teachers. This meeting was held on 26-07-2008 and since then no action has been taken to implement the decision to grant higher pay scale and other incentives to KV teachers.

The Primary teachers in KVs have been denied 4600/ grade pay at stage-1 though many other categories of employees were granted higher grade pay of 4600/- GOI,MOF,Deptt. Of Expenditure New Delhi vide Memo No.F.No., -1/1/2008/Lc dated 13 Nov,2009 granted higher grade pay of 4600/- to employees in pay scale of 6500-200-1500 who were granted grade pay of 4200/0 earlier. Accordingly KVS vide letter No.F.-11081-04/2008-KVS HQ(Admn-1)962 dated 27-07-2010 and letter no. same reference 1102 dated 27-08-2010 granted higher grade pay of 4600/- to Superintendent merged/upgraded to Section Officer in same pay scale of 6500/-. However similarly placed PRTs are denied the benefit of higher grade pay.

This is nothing but injustice with our Primary Teachers and KVS should immediately consider the matter of higher grade pay to PRT’s similarly as has been granted to other employees in the pay scale of Rs.6500-200-10500.

Comments of KVS

The matter pertaining to granting of higher Pay Scale to the teachers of KVS was placed before the BOG of KVS in its 80th meeting held on 26-07-2008. The BOG has decided to constitute a committee under the Chairmanship of the Vice-Chairman, KVS to examine the proposal for granting higher Pay Scale and providing other incentives to the teachers of KVS.

The matter was accordingly taken up with the MHRD for constitution of desired committee. In response the MHRD vide their letter dated 06-02-2009 has conveyed that the competent authority has decided to allow some more time before taking up the issue of further revision of Pay Scale since the pay revision has taken place recently.(copy enclosed).

The association may submit their logical proposal for further enhancement of pay scaled of teaching category employees of KVS as the Ministry is of the view that the pay scales of teachers have been enhanced while implementing the recommendations of 6th CPC.

Decision/Recommendation

The decision of MHRD has already been conveyed to the association. However, the Chairperson, JCM was of the view that the matter may be re-submitted to MHRD for consideration.

9. Extension of CGHS facilities to KV teachers similarly as being extended to KVS(HQ) and KVS(Regional Office,) staff and extension of CGHS facility to KVS employees at par with retired GOI employees:-

Teachers should also be granted CGHS facility as is being provided t KVS HQ and Regional Office Staff. The CGHS benefits available to GOI employees after their retirement should also be available to retired KVS employees as is being extended to NCERT employees.

Comment s of KVS

The matter for extending CGHS facilities to all the KVS employees was taken up by the Sangathan with the Director, CHGS and they have informed that the matter was referred to the Ministry of Health & Family Welfare and who has opined that it is the policy of the Govt. not to extend facilities to new category of beneficiary but consolidated only to those available to existing ones(copy enclosed).

KVS has pursued the matter with the Director, UT-II, Ministry of Human Resource Development, Govt. Of India, New Delhi so many times requesting the Ministry of HRD to reconsider the decision. But the same has been denied, though effort are still being made (copy enclosed). However, the Sangathan will once again take up the matter with Ministry of Health through the Ministry Human Resource Development, Govt. of India to reconsider their decision and CGHS authorities has intended their inability to extend the scheme to any concerned group due to constraints of man power etc. vide letter dated 27.06.2012.

Decision/Recommendation

Although, the staff side and official side were of the view that the CGHS facilities should be extended to all the serving and retired employees of KVS. Since the CGHS authorities have shown their inability in extending the facility for want of infrastructural facilities as such, it was unanimously decided that the matter may be taken up with the Ministry of Health again through MHRD and the progress should be submitted in the next meeting.

Apart from above the Commissioner, KVS was of the view that the Association as well as KVS may explore the possibility of introduction of medi-claim policies being offered by many companies in the respective field, may be from Government Sector or the Private Sector, covering at least 06 persons of a family of the serving and retired employees.

The proposal is not clear. However staffing pattern of non teaching staff in KVs has already been restored by this office vide letter No. 110333/01/2010-KVSHQ/ Aced. Dated 04-06-2010 with the approval of MHRD vide letter No.F. 3-14/2006-UT.2 dated 04-06-2010.

Decision/Recommendation

The association will submit a logical fresh proposal for further examination of KVS.

2. A committee may be formed to settle all the pending Court Cases filed by KEVINTSA and also preferably inpidual Court Cases filed by the Non-Teaching staff including unsettled grievances of similar nature pending at various levels to prevent further court cases under mutual discussions to once and for all settle the matter across the table in a time bound manner.

Comments of KVS

The court cases and all other allied matters such as grievances etc. are being redressed promptly be KVS, hence there is no need to form such a Committee. However, this suggestion may be discussed in JCM.

Decision/Recommendation

The demand of constituting the Committee for the purpose was not agreed to. However, it was agreed that the matters pertaining to Court Cases and other grievances of Association may be resolved after mutually exchange of views at KVS Headquarter level.

3. Duty allocation of non teaching staff commensurate with the pay scale granted to each category of staff at par with Govt. of India pattern, based on proper work study.

Comments of KVS

The proposal is not clear. The Pay scales are granted as per the recommendations of 6th CPC and approved by Board of Governors

Decision/Recommendation

After due deliberation it was decided that a committee may be constituted by KVS soon after issue of minutes of the meeting. The Committee will submit its recommendation describing the job chart of non-teaching staff in Vidyalayas at different level of posts.

4. Creation of promotional avenues for non teaching staff especially sub-staff, who do not have any promotional avenues under the present situation, creating the post of Office Assistants in different Labs/Libraries. Promotion to the post of Lab. Attdt. To be continued as separate seniority is to be maintained for each cadre as per the initial order of KVS(HQ). And also provision to be made for reserving at least 10% of teaching posts of each cadre for the existing non teaching staff having suitable qualification with relaxation for professional qualification, and also provision for section officers and above, possessing Post Graduate qualification to apply for the post of Principal in K.V. Provision may also be provided to all the non teaching staff to participate in at least two higher levels posts under departmental examinations, exclusively for the non-teaching staff working in KVS Provision for TA to attend limited departmental examinations, conducted outside the normal duty station of the non-teaching staff.

Comments of KVS

I) 10% POSTS OF Sub-staff can be promoted to the post of LDC as per revised Recruitment Rules circulated vide OM dated 6.1.2012.

II) No promotion can be given to the posts of Lab. Attendents as the posts of Gr. D and Lab Attendents have been merged with Sub-staff and comes under Group-C post.

III) Non-teaching staff having suitable qualification as per Recruitment Rule can compete for teaching posts.

IV) Deptt. Examination is itself a fast track promotion, as such participation is Limited deptt. Examination for two higher level posts is not justified.

V) There is no provision in KVS for the payment of TA for the departmental candidates appearing in the limited departmental examination.

Decision/Recommendation

Since there is already a quota of 10% of existing staff having the requisite essential qualification from amongst the sub-staff to the post of LDC, the same will continue.

The official side informed that KVS being pace setting institutions cannot grant any such relaxation, which may affect quality of teaching and hence the same cannot be agreed to .

5. Five days week to be observed for all the non-teaching staff working in KVS at par with their counterparts working in KVS, ROs, KVS, ZIETs and HQ.

Comments of KVS

The Academic Advisory Committee did not find the proposal of 5 days week at this juncture for the teaching staff. Keeping this in view, it is not possible for KVS to introduce 5 days week for the Non-teaching staff of KVs.

Decision/Recommendation

In view of implementation of RTE 2009 it is not possible at present. However, the matter regarding working hours is already sub-judice. The President, AIKVTA informed that there are so many other institutions who are observing 05 days week. The Chairperson, JCM directed him to submit the details with supporting documents of such institutions who are imparting the school education, observing 05 days week as in the matter of teaching staff.

6. Sub-Staff to be treated as Non-Vacational Staff, as their requirement during vacation and breaks is essential.

Comments of KVS

The decision of conversion of Sub-Staff employees of KVS to non-vacational staff as circulated vide KVS circular dated 29-10-2001 (copy enclosed) was taken with the approval of the Board of Governors of KVS in its 70th meeting after examining all pros and cons of the new provision and the same has been successfully implemented since last 10 years. There is no suggestion from the Regional Offices/ Vidyalaya administrations and as such there appear no need to review it.

Decision/Recommendation

After due deliberation it was agreed by officials side that the matter will be reconsidered by constituting a Committee for the purpose.

7. All the non-teaching staff retiring from November of an academic year, be also be re-employed until close of that financial/academic year, as has been provided to Principals/Teachers.

Comments of KVS

Presently, in KVS the provision for re-employment is available only in the matter of teachers, retiring on superannuation on or after 30th, November of each year. Necessary guidelines have already been issued by KVS vide its circular dated 15-11-96 & 19-03-97. The demand of KEVINTSA i.e to the extent the same scheme to the Non-Teaching employees of KVS deserves to be discussed in the ensuing meeting of the JCM.

Decision/Recommendation

The matter was discussed in detail and since no proper justification was submitted by the staff side the Chairperson did not agree to it.

8. The existing Transfer Guidelines be amended to incorporate the views of the Recognised Associations to formulate a consistent and transparent transfer policy for the non-teaching staff, taking into account the organisational requirements, and also human resources satisfaction and comparing the transger polices in vogue in other Central Govt. Departments.

Comments of KVS

Since KVS is a big organization and its Kendriya Vidyalaya are spread out all over India including hard/very hard station/J&K etc., the transfer policy of KVS may not be made at par with Govt. of India’s transfer policy. However, due weightage has been given to elements which are given below to effect the transfer in fair and transparent manner as per the requirement of the employees of KVS. The existing transfer guideline are framed with due deliberation applicable to the staff of KVS. The elements are as under:-

1. Spouse, if a KVS employee and posted at the same station has been allotted -15 points to avoid from being displacement and +15 points for seeking request transfer, if spouse is working at the requested station or within 100kms.

2. Spouse, if working in Govt. Sector and posted at the same station has been allotted -10 points to avoid from being displacement and +10 points for seeking request transfer if spouse is working at the requested station or within 100 kms.

3. Physically challenged employees have been allotted -50 points to avoid from being displacement and +40 points for seeking request transfers.

4. Women employee have been allotted -10 points to lower down their displacement counts from being displacement and +10 points for seeking request transfers to increase their transfer counts.

5. Members of recognized association of KVS staff who are members of JCM at KVS, Regional Offices and/or KVS(HQ) have been allotted -15 points to avoid from being displacement.

Decision/Recommendation

The demand of Association was not agreed in to-to. It was informed that keeping in view of difficulties of non-teaching staff, Sangathan is considering transfer of non-teaching staff either on their request or on Administrative ground on case to case basis.

9. A nodal office must be created in KVS (HQ) to monitor and to take appropriate action on the representations of Recognized Associations and provision created to meet officers of KVS on periodicals basis, preferably on monthly basis to settle off.

Comments of KVS

Earlier the matter pertaining to Associations/JCM were looked after by a separate section namely Admn. III. During the year 2002. Admn. III Section was merged with Admn-I Section and since then the work is being looked after by Admn-I, section only, although the matter of looking after of work is not the subject matter of the association, yet in view of the increased work load because of the expansion of the KVS, there is need to create more sections to discharge the work qualitatively and qualitatively on faster track. Sangathan would like to examine the matter after discussion in the forthcoming meeting of JCM.

Decision/Recommendation

The matter pertaining to association matters are being attended to by a separate Section in KVS. However, the Hon’ble Chairperson was of the view that some more attention is to be given for speedy disposal.

It was also clarified to the Association that the frivolous matters and inpidual cases should not be referred to.

10. Conversion of the few CPF optees to GPF/Pension scheme as has been provided to many categories of staff working in other Central Govt. Departments.

Comments of KVS

Proposal was forwarded to the MHRD for onward transmission to the Ministry of Finance vide file No.110-125/2011-12/2/KVS conversion on dated 02.05.2012.

Decision/Recommendation

The staff side must bring the examples from similar Central Government Departments to strengthen their case however, the matter is already under consideration by MHRD. The decision thereon may be communicated in due course of time.

11. Representation of the non-teaching staff in the BOG of KVS, as per Article 43 A of the Constitution of India.

Comments of KVS

As on date there are 25 members on the BOG of KVS and 31 members in the General Body of KVS. As on date there is no provision in the MOA and rules of KVS for nomination of members of Association of teaching and non teaching staff. However, it is not possible.

Decision/Recommendation

After due deliberation it was found that there is no justification in the demand of Association.

12. Extension of Infrastructural facilities for proper functioning of Recognized Association at station headquarter of General Secretary/President & Regional Secretary/Regional President.

Comments of KVS

As sper KVE (RSA) Rules, 1995, the recognized staff associations are allowed to collect annual subscription from its members which is expected to be utilised fro the association welfare measures including infrastructural facilities.

It would not be possible to provide infrastructural facilities out of Government Grants.

Decision/Recommendation

After due deliberation it was recommended by the Chairperson, JCM that KVS may explore the possibility to provide a room where the General Secretary/President of a recognized association is posted, subject to it availability.

Additional Agenda Item

1. With the permission of Chairperson the Additional Agenda regarding grant of MACP to teaching staff was submitted by President of AIKVTA. He pointed out that KVS is not granting MACP to teachers of KVs.

Comments of KVS

The Commissioner, KVS clarified that the matter pertaining to grant of the benefits of MACPS to the teaching category employees of KVS is under active consideration of Ministry of HRD and Ministry of Finance, Government of India. The decision of the Government is still awaited.

Decision/Recommendation

The Chairperson, JCM was of the view that KVS may continue its efforts with the Ministry.
