OFFICE MEMORANDUM
Subject:-ย ย Clarificationsย ย ย regardingย ย Introductionย ย ofย ย Pensionย ย Schemeย ย andย ย Post Superannuation Medical Benefits in CPSEs
The undersigned ย is directed to refer to this Department OM No. 2(70)/08-DPEย (WC) dated 26.11.2008 and 2(70)/08-DPE (WC) dated 2.4.2009 regarding pay revision of executives and non-unionized ย supervisorsย of CPSEs w.e.f. ย 1.1.2007 which inter-alia providesย guidelines regarding Superannuation benefits including Pension and Post Superannuation Medical Benefit Scheme of the CPSEs.ย ย DPE has been receiving certain queries in this regard. The following clarifications may be kept in mind while finalizing the Pension and Post Superannuation Medical Benefit Scheme of the CPSEs:-
i)ย ย ย ย ย ย ย ย The condition of 30% of Basic Pay + DA for superannuation benefits as prescribed in DPE O.Ms. dated 26.11.2008 and 02.04.2009 and as amended from time to time, are to be followed strictly.
ii)ย ย ย ย ย ย ย These schemes (pension and post-superannuation medical benefits) would be subject to the factors like affordability, capacity to pay and sustainability of the CPSE.
iii)ย ย ย ย ย ย Government budgetary support would not be provided to operate these Schemes.
iv)ย ย ย ย ย ย It is to be ensured that by implementing the 2007 pay revision, which would include these two schemes, the dip in Profit Before Tax (PBT) for the year 2007-08 should not exceed 20% in respect of executives & non-unionized supervisors of CPSE.
v)ย ย ย ย ย ย ย Since the ย effective ย date ย ofย 2007 payย revision in CPSE ย is 01.01.2007, theย proposed scheme(s) may ย be ย introduced ย w.e.f. 01.01.2007 or a subsequentย date for the regular employees who were on the rolls of CPSE as on that date and for the employees recruited thereafter.ย ย If a regular employee does not want to contribute to the proposed scheme, he/she should have an option.
vi)ย ย ย ย ย ย ย ย ย ย ย ย ย ย ย ย ย Contribution of CPSE to these schemes is limited to such extent that the contribution to the total superannuation benefits which include PF and Gratuity also is limited to 30% of Basicย ย ย ย ย ย ย ย ย ย ย payย ย ย plusย ย ย DA.ย ย ย ย ย ย Thisย ย mayย ย beย ย reviewedย ย everyย ย ย yearย ย ย basedย ย onย ย the profitability/affordability ย of the CPSE. Contribution every year by ย CPSE should not be guaranteed for these two schemes.
vii)ย ย ย ย ย ย An employee should have put in a minimum of 15 years service rendered in continuity in CPSE(s) at the time of superannuation, and benefits would be allowed by a CPSE from where the incumbent has superannuated.
viii)ย ย ย ย The services rendered in the Government prior to joining CPSE would not count for the purpose of computation of total service in a CPSE required for availing the benefits of this scheme.
ix)ย ย ย ย ย ย As regards Board level executives, who are contractual appointees, they too can enjoy theย benefits ย under ย these ย schemes provided theirย total period ย of ย service ย rendered in continuity in CPSE( s) including the period at Board level in a CPSE is not less than 15 years, at the time of superannuation.
x)ย ย ย ย ย ย ย In the event of any employee resigning from the services of CPSE and joining another CPSE having ย broadly ย similar schemes, the entire amount of employer’s and employee’s contribution ย along ย with ย interest ย accrued thereonย can ย be ย transferred ย to ย such ย CPSE. However, employees who resign from CPSE to join another CPSE, not having similar schemes, or any organization not being a CPSE (irrespective of whether such scheme exists in that organization), shall not be allowed the benefit of transferring their accumulated ย fundย under ย these schemes. However, theย employee’s ย contribution ย along with accrued interests shall be refundable to the employee.
xi)ย ย ย ย ย ย Benefits of the schemes should not be extended to employees posted on deputation to
CPSE from Central/State Government.
xii)ย ย ย ย ย In ย case ย a ย regular ย member ย of ย the ย scheme ย dieslbecomes ย permanently ย disabled ย & incapacitated, leading to cessation of hislher service, before putting in 15 years of service in a CPSE prior to superannuation, he/she may be given the benefits as admissible under these schemes.
xiii)ย ย ย ย Cases of VRSNSS ย for which specific scheme have been framed would be examined in terms of such specific schemes of VRSNSS ย of the Government applicable in respect of employees ย of ย CPSEs. ย Benefits ย under theseย schemes would not ย accrue to ย VRSNSS optees automatically.
xiv)ย ย ย ย At the time ย ofย superannuation, ย an employee may opt for Annuities ย from any of the designated Annuity Saving Service Providers to provide the pension and/or post retiral medical benefits.
xv)ย ย ย ย The ย admissibility ย of ย benefits ย under these ย schemes to ย the ย employees ย against ย whom disciplinary proceedings are pending at the time of superannuation is to be regulated as per the Conduct, Discipline & Appeal Rules of the CPSE.
xvi)ย ย ย ย In cases of resignation (excluding resignation covered under ‘technical formality clasue’) and compulsory retirement, removal, dismissal because of disciplinary proceedings, the annuity would be based only on member’s ย contributions, if any, and interest thereon.
xvii)ย ย ย ย DPE ย O.Ms. ย dated ย 08.07.2009ย ย and ย 20.07.2011ย ย relate ย to the ย creationย ย of a Corpus ย for the CPSEย ย employeesย ย who ย retired ย before ย 01.01.2007. ย There ย is, thus, ย no link between ย pension and ย post-superannuationย ย ย ย medicalย ย benefit ย schemesย ย and ย the ย corpusย ย mentionedย ย in ย O.Ms. datedย 08.07.2009ย ย and 20.07.2011.
xviii)ย ย ย These ย schemesย ย will ย be under ย a “defined ย contributionย ย scheme”ย ย and ย not ย under ย a “defined benefit ย scheme”.ย ย ย ย Subject ย toย the ย contributionย ย made ย by the ย CPSE ย within ย the ย prescribed ceiling,ย ย and ย basedย ย on ย affordability,ย ย ย the ย benefitย ย to ย the ย individualย ย ย executiveย ย would ย be determinedย ย based ย on the accumulatedย ย amount.
xix)ย ย ย ย ย There ย should ย be no provisionย ย of ‘commutation’,ย ย ย since provisionย ย of pension ย in ย 2007 pay revision ย guidelinesย ย was ย introducedย ย so that ย employeesย ย have ย a social ย security ย and ย would get a substantialย ย monthly ย pension ย after superannuation.
