Employer Decides Qualification Equivalence: Allahabad HC Ruling

In a crucial decision, the Allahabad High Court ruled that the equivalence of qualifications is a matter for the employer to decide, not the courts. This ruling came as the Court overturned a decision by the Central Administrative Tribunal (CAT), reinstating the appointment of Smt. Madhumita Pandey as Gramin Dak Sevak (GDS) Branch Postmaster in Baraon, District Deoria.

Case Background

The Postal Department’s 2010 recruitment process for GDS Branch Postmaster led to the selection of Madhumita Pandey, who ranked third on the merit list based on her high school marks. However, her qualification, a Prathama certificate from Hindi Sahitya Sammelan, was challenged by another candidate, Smt. Kalpana Tripathi, who claimed the certificate did not meet the advertised requirement of a recognized matriculation certificate.

Tribunal’s Ruling

In March 2024, the Central Administrative Tribunal ruled in favor of Kalpana Tripathi, canceling Madhumita’s appointment. The Tribunal argued that Madhumita’s qualification did not fulfill the requirements mentioned in the job advertisement.

High Court’s Decision

The Allahabad High Court, however, ruled in favor of Madhumita. The Court emphasized that recruitment rules issued by the Postal Department allowed for equivalent qualifications, and these rules should take precedence over the job advertisement. According to the 2006 Government of India notification, the Prathama certificate was provisionally recognized as equivalent to matriculation for Central Government jobs between 2007 and 2010, a period that covered Madhumita’s recruitment.
