I was appointed as Resident Medical Officer in a CSIR Lab in the pay scale of 8000-275-13500 and given the benefit of 3 advance increments due to post graduation qualification. My starting basic pay was ₹8825/-. I joined the office on 14.08.2002. At the same time a lady doctor was appointed as Lady Medical Officer in the same Lab with starting basic pay of ₹8000/- but she joined on 17.06.2002. Both of us were selected by the same panel of experts on the same date and our job profile is also the same. Later on both of us were given 1st and 2nd promotion in 2007 and 2012 by the same panel of experts and on the same date. Each time I opted for Pay fixation w.e.f. date of promotion i.e. 14th August whereas she opted for pay fixation w.e.f. date of increment i.e. 1st July. We were also given benefits of 6th and 7th CPC w.e.f. 1.1.2006 and 1.1.2016 respectively. However, the lady doctor was given an additional increment as recommended by the 6th CPC as she had joined before July.
On 01.07.2017 my basic pay was fixed at ₹1,15,800 whereas the lady doctor’s basic pay was fixed at ₹1,12,400 (prior to the third promotion).
Now both of us have been promoted from Pay level 12 to level 13 with the same basic pay of ₹1,23,100 from 2017. But the lady doctor’s pay has been fixed w.e.f. 17.06.2017, whereas my pay has been fixed w.e.f. 14.08.2017. So my basic pay remains at ₹1,15,800 from 17.06.2017 to 13.08.2017. Moreover, as lady doctor’s pay was fixed w.e.f. 17.06.2017, she gets her next increments on every 1st January whereas I get the increments from 1st July every year. So the basic pay of LMO was 1,26,800, 1,30,600 and 1,34,500 w.e.f. 01.01.2018, 01.01.2019 and 01.01.2020 respectively, whereas my basic pay was 1,26,800, 1,30,600 and 1,34,500 w.e.f. 01.07.2018, 01.07.2019 and 01.07.2020 respectively.
This situation has arrived due to application of 7th Pay Commission report. Therefore I requested my office to give me the benefit of stepping up of pay w.e.f 17.06.2017. But my office rejected my claim stating that the two posts belong to different cadres, there is no question of seniority and hence I am not eligible for the stepping up of pay.
