Can anyone help to clarify the following please?
A Trained Graduate Teacher (TGT) of the Department of Education was appointed as Lecturer (Ex-cadre) in the same Department in the Pay Band plus Grade Pay (PB-2) 9300-34800 + 4800 on deputation basis on 19-11-2008. After one year of deputation he was permanently absorbed in the ex-cadre post of Lecturer from 26-11-2009. The officer has chosen his parent grade plus 10% Deputation (Duty) Allowance. During the time of permanent absorption in the ex-cadre post he was drawing pay Rs. 16750 in PB-2 + GP 4800 + 10% Deputation (Duty) Allowance Rs. 2155.00. Total Rs. 23705.00. At this point of time his emoluments drawn prior to his permanent absorption was drop down by 10% (i.e by Rs. 2155.00) as a result of ceasing his deputation allowance from 26-11-2009.
As per FR 22( Govt. of India O.M. No. F.1(11)-E.III (/69 dated 20th January 1970 the fixation of pay of Government Servants in ex-cadre post on their permanent absorption while on deputation, have to be fixed without any drop in the emoluments drawn by the Government servant concerned, the difference between the pay so fixed and pay plus Deputation (Duty) Allowance drawn prior to absorption may be allowed as personal pay to be absorbed in future increases in pay.
• Additional Pay granted to a government servant to save him from a loss of substantive pay in respect of a permanent post other than a tenure post due to a revision of pay or to any reduction of such substantive pay otherwise than as disciplinary measure. (FR-9(23))
• Personal pay shall be reduced by any amount by which the recipient’s pay may be increased, and shall cease as soon as his pay is increased by an amount equal to his personal pay (FR 37)
Q1. How is the pay of the Officer fixed in the ex-cadre post on his permanent absorption while on deputation with personal pay?
