Somebody may kindly clarify the following
A senior govt employee ‘X’ has passed the departmental examination in the year 2007 and grant two advance increment, after grant two advance increments ‘X’ promoted to next senior post on July 2008. After fixation on promotion Mr. ‘X’ pay was just exceeds the minimum pay on the higher post i.e. at Rs.17230/-.
Again, Mr. ‘Y’ the junior govt. employee(junior from Mr. ‘X’ in every context) has promoted to the same higher in June, 2009 and fixed the pay on the post minimum at Rs.17140/-. Thereafter, Mr. ‘Y’ has passed the same departmental exam (earlier passed by Mr. ‘X’ in the year 2007) in Oct, 2009 and granted two advance increments on fixation. Now the payment of Mr. ‘Y’ (Junior) is exceeds to the Payment of Mr. ‘X’ (Senior) after grant two advance increments (which already granted to Mr. ‘X’ in the year 2007).
Please clarify that the Anomaly arises or not and payment of Mr. ‘X’ (Senior) is stepped up with Mr. ‘Y’ (Junior) or not.
If, yes kindly provide the Rule and/or case law, if any.
