These are various issues discussed in first meeting of Joint Committee of MACPS held on 25.05.2010.  This committee was formed by the Government recently to examine anomalies in Modified Assured Career Progression Scheme implemented consequent on implementation of pay commission with effect from 1.9.2008

Provide Grade Pay of the next promotional post under MACP:

Staff Side pressed for placement in the Grade Pay of the Promotional Post instead of next higher Grade Pay in the hierarchy of revised Pay Band and Grade Pay. It was insisted because the career progression only means the promotion in the hierarchy and not to a Grade Pay which is not present in the hierarchy of the respective department.

The Staff Side also gave an alternative that first two MACPs after 10 and 20 years should be to the next promotional post as per the hierarchy of respective department as under the erstwhile ACP scheme and thereafter the third MACP in the next Grade Pay of the Revised Pay Band and Grade Pay.

Date of Effect:

It was demanded that MACP scheme may be introduced with effect from 1.1.2006. A scheme which has been recommended by the 6th CPC will be not available to those employees who have opted for revised pay scales w.e.f. 1.1.2006 but had retired or died before 1.9.2008, which is very anomalous.

Option for earlier ACP Scheme:

Staff Side pointed out that the benefit which employees were getting through two ACPs after 12 and 24 years of service is much higher than the benefit that they will get under MACP after three financial upgradations. It was therefore urged that the service conditions which were available to the existing employees cannot be adversely revised and if that happens then an option to retain the old scheme is inherent. And if the present MACP is not converted to hierarchical pattern, then at least an option may be given to retain the erstwhile scheme of ACP.

Grant of financial upgradation between 1.1.2006 and 31.8.2008:

In Para 9 of the DOPT OM dated 19.5.2009, it had been provided that earlier ACP scheme will continue to operate for the period from 1.1.2006 to 31.8.2008. However, this is not being allowed to officials who have opted for revised Pay Band and Grade Pay with effect from 1.1.2006. In some offices, it is being insisted that financial upgradation under the earlier ACP would be granted only in the pre-revised pay scales and they will have to opt for the revised pay scales only from the date they are granted the financial upgradation under earlier ACP. It was demanded that earlier ACP benefit may be given also to those officials who have come over to the Revised Pay Band and Grade Pay with effect from 1.1.2006.

Anomaly on introduction of MACP Scheme:

By an illustration in respect of Junior Engineer of CPWD, it has been pointed out that under earlier ACP they will go up to the revised Pay Band 3 with Grade Pay of 6600/- on completion of 24 years of service, whereas under the MACP Scheme, even after 30 years of service and getting third MACP they will get the Grade Pay of 5400/- only in PB-2. This is obviously less advantageous and therefore the demand for option to retain the old ACP scheme has been insisted.  The Official Side indicated that they will consider all these demands and in the next meeting they will indicate how far they can go.

Applicability of MACP Scheme to Group D employees who have been placed in the Grade Pay of 1800/-:

The DOPT had already stated that all promotions and upgradations granted under ACP Scheme of 1999 in the post of four pay scales S-1, S-2, S-3 and S-4 shall be ignored for the purpose of MACP. In other words all the three MACP will be available to all the Group D employees who have since been placed in the grade pay of 1800/-. If an employee has completed 10 years of service he should be granted the GP of 1900/-; if completed 20 years of service he should be granted the GP of 2000/-; and if he has completed 30 years of service he should be placed in the GP of 2400/-. In some departments these MACP has not been granted to the Group D employees. The staff side therefore insisted an enabling clarificatory instructions may be issued. The Official Side agreed to issue such clarificatory instructions.

Counting 50% of service rendered by Temporary Status CLs for reckoning 10,20, and 30 years of service under MACP scheme:

It was pointed out that the Railways have already issued orders for counting 50% of service rendered by Temporary Status Casual labourers for reckoning 12 and 24 years of service under the old ACP scheme. It was also pointed out that Courts have also ordered that total service rendered as TS CLs may be counted for the purpose of ACP. The Official Side were of the opinion that 50% of service rendered by TS CLs has been counted only for the purpose of pension. The Staff Side pointed out that the TS CLs have been granted all the facilities admissible to a Temporary Employee in respect of leave, increment, pay scale etc and therefore this may be deemed as a regular service for the purpose of MACP also as has been done by the Railways. The Official Side wanted the order of the Railway Department regarding ACP and the Orders of the Courts for their examination.

Supervised staff placed in higher Grade Pay than that of the supervisor:

The Staff Side suggested that this item may be transferred to National Anomaly Committee item and discussed there. This has been agreed to.

Other issues:

There are 23 more items which have been suggested by the Staff Side leaders of Railways. It was pointed out that leaders of other departments may also suggest many other anomalies related to MACP. The Staff Side stated that as and when these additional items are received they may be included in the Agenda for discussion in the subsequent meetings. The Official Side agreed to.

    Issues befor joint comittee meeting of MACP-Supervised staff placed in higher Grade Pay than that of the supervisor.
    This is a very serious point which is destroying the morale and confidence of the Supervisory staff who have come up from clerical cadre. This abberation has seriously affected in all the areas of official system.

    Under MACP an employee whose grade pay has been fixed @ Rs.1800/- w.e.f. 1.1.2006 will get a grade pay of 1900, 2000 and 2400 on completion of 10, 20 and 30 years respectively. That means he is getting the grade pay of UDC. This benefit is for the no. of years he has rendered. No UDC can complain that he is getting their grade pay. He is getting only monetory benefit. In no way his work and UDC’s work can be compared. Difference between LDC who got appointment through SSC All India competitive examination is getting only Rs.100 difference than erstwhile Group D staff who is getting the benefit after undergoing a training of 1 week. Let them get the benefit no body questions but the grade pay difference should be increased. The problem in question is because under ACP scheme, employee is getting the grade pay of promotional post and under MACP scheme only next grade pay. Those who got 2 ACPs already in the promotional post will be getting one more under new MACP. That is why this has happened. Under ACP also same thing happened. The benefit they are getting only after 30 years on the verge of retirement.

    Please refer No.35034/3/2008-Estt. (D) dated 19.5.2009 of D.O.P.T. regarding Implementation of New MACP Scheme for Central Govt Civilian Employees issued by DOPT and clarify that the “upgradation granted under ACP to the pre-revised scale of Rs. 5500-9000 on 1.1.2004 (1st ACP only) after completion of 12 years of service in a particular grade from the pre-revised scale of Rs. 5000-8000, and no further regular promotion is applicable till date and after implementation of 6CPC my grade pay is Rs. 4200/- now. What grade pay should be given to me by the office after implementation of MACP? And also tell me about 3% increment from 1.9.2008 after implementation of MACP please.

    If you have entered in Govt service in scale 5000 then you will get GP 4600 as your MACP on completion of 10 th year or 1/9/08 whichever is earlier and you will get 3% FIXATION ALSO FOR macp

    Will the anomaly committee will address the issues related to group A officers?
    If so when will be the next meeting.
    the main issue is reducing the gap between pb3 and pb4 i. e awarding pay hike for people at pre revised 12k scale.

    anyone is having information on this issue?

    I AM A RETD ASST FOREMAN,RETIRED ON 31.08.2008 IN THE BASIC RS 21450(16850+   4600)IN PAY BAND RS 9300-34800.WE ARE NOT UPGRADED TO 7450-225-11500.GOT PROMOTION ON 14.04.2007 TO ASST FOREMAN IN THE SCALE RS 6500-200-10500 FROM
    CHARGEMAN GR-1 IN THE SCALE OF RS 5500-175-9000.RENDERED BONAFIED SERVICE OF 33YRS ON 2004.WITH A TOTAL SERVICE OF 37YEARS AT THE TIME OF RETIREMENT.  SHALL I GET MACP AWARD ?

    MACPS takes effect only from 1.9.2008 which guarantees 3 promotions/upgradations. Unfortunately you retired on 31.08.2008. You will not covered by MACPS. But you should have been given at-least 2 promotions / upgradations in your career as per old ACP Scheme.

    after implementation of macp, JE’s of CWC ( central Water Commission)who had completed 24 year service before 01.09.2008 are getting Rs 5400 Grade Pay whereas after 01.09.2008 are getting Rs. 4800.After completion of 30 years service they will get Rs. 6600 Grade Pay (macp III) and we will get Rs. 5400 grade Pay ( macpIII). In the same post Grade pay’s are different.What is the way to solve the such type of anomaly in grade pay in the same post of Junior Engineer of CWC?.Kindly inform

    Section Officers and PSs in the Central Government deserve to be in Grade Pay 5400 in PB 3 in their entry grade so that a reasonable difference in Grade Pay of at least of Rs. 800 (i.e. 5400 minus 4600) is kept between the entry grade of Assistants and PAs who are now in the Grade Pay of Rs. 4600. This would mean that the Joint Anomaly Committee should consider removing the two intermediary Grade Pays i.e. Grade Pay 4800 and Grade Pay 5400 in PB 2 in respect of Central Government employees in these cadres considering that the next Grade Pay in hierarchy of posts i.e. that of Under Secretary and PPS is Rs. 6600 which has a respectable difference of Rs. 1200 in the Grade Pay (i.e. 6600 minus 5400).

    The above arrangement will clearly give 3 career progressions/upgradations in the promotional post to many of those whose entry Grade is Rs. 4200 i.e. their first upgradation in the promotional post will be in the GP 4600, the 2nd upgradation in GP 5400 and the 3rd in GP 6600 while the benchmark set under the MACP will be the same i.e. completion of 10 years in the same GP or on completion of 30 years of service since their entry in GP 4200, which ever is earlier.

    The three career progression/upgradation in the promotional scale is a very reasonable demand by the staff side and this will also be in line with Government’s actual intention which was to give 3 career progressions under MACP instead of 2 in the earlier ACP Scheme.

    Respected Sir,
    Sub: Anomalies in the pensionary benefits payable to the
    employees Absorbed in AB / PSUs etc–reg.

    I took appointment in ESIC Hospital with 28 years of service in 1995 with further service of 13 years in ESI Corporation with an option of pensionary benefits for the combined service under the State Government of Tamilnadu and in ESIC as per the pension rules followed at that time. I could get only DCRG and full pension after retirement. When a Government servant is absorbed in an Autonomous body / PSUs etc, he will have an option (a) to receive pro rata retirement pensionary benefits or (b) continue to have the pensionary benefit of combined service under the Government and in the Autonomous Body. Under option (a), 100% commutation of pension was also paid up to 1995 if he opted for it. This option shall be exercised within six months from the date of absorption.

    Those who desired full pension, opted for combined pensionary benefits like me. Others opted for pro rata pension. But the various pension rules amended periodically and sixth pay commission orders announced by Govt of India as well as several court judgements have extended attractive pensionary benefits to the absorbed employees opted for pro rata pension. The employees opted for combined pensionary benefits were completely ignored and deprived of getting such benefits which is purely discrimination.

    In case had I opted for 100% Commutation under option (a), I would have got DCRG & 100% Commuted value of pension on absorption , Restoration of 1/3rd commuted pension after 15 years granted wef 1998, monthly Dearness Relief granted wef 1998 , DCRG & Better Pension in addition to the above on retirement.

    Had I opted for pension under option (a), I would have got DCRG and monthly pension on absorption, Restoration of 1/3rd commuted pension after 15 years, monthly Dearness Relief granted wef 1998, DCRG & Better Pension in addition to the above on retirement.

    I am affected severely because of the option (b) for combined service pension exercised at the time of appointment. It is due to the lacuna in the pension rules and option regulations. In order to rectify the anomalies and discriminations experienced in the unforeseen circumstances, such as change in pension rules, court orders, pay commission orders, condition of service etc, Government will usually provide an option to all concerned employees to exercise in the light of new rules so that there could not be any anomaly in the benefits due to them. Since it is not given to the absorbed employees opted (b) for combined service pensionary benefits like me, I request the Committee to kindly take up my case for extending similar benefits at par with the group of employees opted (a) for pro rata pension with appropriate orders like the one as given below.

    The parent department is restoring 1/3rd commuted value of pension to the employees opted (a) after 15 years for whom 100% commutation benefits was paid already which is nothing but a double benefit to them. But it is not giving such restoration benefit to those who opted (b) though they were not paid such benefits. It has to be noted that the parent department has paid such 100% commuted value of pension to the Autonomous Body which absorbed these employees in order to grant pension for the combined service. Since the liability of pensionary benefits of parent department is the same for both categories, irrespective of the payees, it shall be ordered to restore 1/3rd commuted value of pension to the employees opted (b) also after 15 years.

    The Autonomous Body is granting full pension and DCRG to the employees opted (b) for which it has received payment of 100% commuted value of pension and DCRG from the parent department. It is also granting full pension along with DCRG to the employees opted (a) with 20 years of service without getting any such amount from parent department as per the sixth pay commission orders. Since it has not received any amount from parent department for granting pension to the employees opted (a), it is not correct to get such payment for granting pension to the employees opted (b).Therefore it shall refund the amount along with interest to the employees opted (b) which was collected by it from the parent department.

    Since the absorbed employees opted for combined service pension were discriminated and became a material for criticism among the group of absorbed employees by virtue of their option and the various pensionary benefits extended by Government of India to the employees opted (a) ignoring the employees opted (b) as detailed above, the committee is requested to cause necessary action for the issue of suitable orders granting the following benefits to the employees opted (b) in order to eliminate the discrimination made to them.

    1. The parent department shall be ordered to restore 1/3rd commuted value of pension to the employees opted (b) after 15 years from the date of absorption.

    2. The Autonomous Body / PSUs etc. shall refund the undue amount along with interest to the employees opted (b) which was collected by it from the parent department. However it may be allowed to retain proportionate amount, in case the qualifying service for granting full pension is less than 20 years since they have already opted for full pension.     Clarification 2: The Method of fixation of pay on promotion after 01.01.2006
    On promotion from one grade to another / financial upgradation under ACP , a Government servant has an option under FR22(I)(a)(1) to get his pay fixed in the higher post
    WHAT IS THE MEANING OF THIS CLARIFICATION? – SABAPATHI

    This option has to be exercised by employee for fixing his increment date in the case of promotion, MACPS upgradation etc. For example, if you are eligible for MACP as on Feb-2010, you will be eligible for MACPS increment as on Feb-2010. However, you will not be eligible for regular increment during july-2010 due 6 months condition. So it will be beneficial if you move your MACP increment to july-2010

    1. Why Higher Level (Class 1) Officers are given 5-6 promotions without passing further exams for promotion ? i.e. Under Secretary –>1. Deputy Secretary –>2. Director –>3. Joint Secretary –>4. Additional Secretary –>5. Secretary –>6. Cabinet Secretary; etc.

    2. Why Lower Level Officials (other than Class-1 Officers) are restricted to only 01 or 02 promotions without passing further exams for promotion ?

    3. What is the Government planning/doing for reducing Strikes/Agitation, corruption and Court Cases etc. at Lower Levels (other than Class 1 Officers)?

    4. What is the Government planning/doing to reduce Mess at lower levels (other than Class 1 Officers) and doing efforts for smooth sailing for promotions etc. as available at higher levels (Class-1 Officers)?

    5. Why generally LDC has to pass UDC exams and prove oneself to get maximum 03 promotions ? LDC-1. UDC (after Exam) -2. Assistant & -3. S.O. (Promotion)

    6. Why mostly Assistants have to pass S.O. exams and show skill to get max. 03 promotion ?Assistants – 1. S.O.(after Exam) 2.Under Secretary 3. Deputy Secretary (promotion)

    7. Why LDC has to pass UDC and S.O. exams and then entitled for max. 04 promotions ? LDC-1.UDC (Exam)-2, Assistant (promotion)-3. S.O.(Exam)-4. U.S (Promotion)

    8. Why exams at only lower levels for promotion, when most of them are Graduates except Peons ?

    9. Why not exams for promotion at higher level (Class 1) Officers, when most of the competence, skill, knowledge, responsibility etc. is required at higher levels for policy making, framing rules & regulations, FR & SR, new projects, Court Cases, foreign tours, planning etc. ?

    10. Who makes Promotion/Recruitment Rules, Pay Structure etc. for Lower Levels officials (other than Class-1 Officers) in Government of India ?

    11. Why not at least benefit of 4 Promotions be given to lower levels (other than Class 1 Officers), without passing any further competitive exams for promotion ?

    12. What is the Government of India planning/doing for conducting competitive exams even for promotion at higher levels (for promotion of Class 1 Officers) ?

    13. What is the Government of India planning/doing for providing equivalent pay/salary for the denied due leaves, when leaves are denied in the interests of the work of the Government, while higher level (Class 1 Officers) generally get not only, due leaves, but also, enjoy foreign Seminars/Tours/Trainings/Workshops etc. along with financial benefits including Foreign Allowance, TA / DA etc.?

    14. What is the Government of India planning/doing for fixing of salary from the date of issue of Promotion Order, instead of date of joining, when joining is delayed/deferred, in the interests of the work of the Government, as joining of duty of Lower Level Officers (other than Class 1 Officers) on promotion is delayed/deferred, thereby causing lot of financial losses to them, while Officers at higher levels may generally join duty immediately/same day of Promotion Orders?

    15. Who keeps the interests of Lower Level Officers (other than Class 1 Officers) all the time, while framing FR & SR, other rules etc. – Government / Higher Level Officers / Agitation / Strikes / Unions / Welfare Associations / Courts ?

    16. What is the Government of India doing for removing in-between Grade Pays between the two Posts for Lower Level Officers (Please see Table given below)

    17. How many Vigilance Cases are pending in Departments of Government of India against (i) Higher Level (Class-1 Officers) (ii) Lower Level Officials, (Please give separate figures)?

    18. What is the Government planning/doing to provide equal number of promotions to Lower Levels, as is given to Higher Levels (Class-1 Officers) ?

    19. What is the Government planning/doing to protect the interests of Lower Level Officers (other than Class-1 Officers), as and when the Rules for Promotion/Recruitments/Pay Scales etc. are amended/framed?

    20. Why the Government of India is not interested to give the benefit of Actual Grade Pay of next promotion to lower levels, even after their 10 years of Service ?

    21. How much the total amount of Salary paid including Foreign Allowance, TA, DA was given during the last four Financial years separately to (i) Higher Level (Class-1 Officers) (ii) Lower Level (other than Class-1 Officers) of Government of India year-wise ? (Please give figures separately for (i) and (ii)?

    22. Why not, Promotion Rules, Recruitment Rules (FR & SR) including modified ACP Rules, etc. may be made and considered in such a manner, which may provide smooth sailing not only at higher levels, but also at lower levels, thereby minimizing mess, agitation, strikes, corruptions, court cases, etc. at lower levels ?

    23. How many total court cases are pending of (i) Higher Level (Class-1 Officers) (ii) Lower Level (other than Class-1 Officers) in Departments of Government of India?

    24. What is the Government of India planning/doing for upholding the promotions of Class 1 Officers for more than 10 years, so as to bring all the Officials under the Modified Assured Career Progression (MACP) and reduce the overall burden of expenditure on Salaries etc. ?

    25. What is the Government of India planning/doing to insert Grade Pays in between two posts also for Higher Ranks (Class 1 Officers), as are applicable for Lower Officials

    Mr Sabhapathi, the clarification 2 given by M/o Finance vide thier letter dated 13.09.10 is for other purpose and not as stated by Admin reply. There are some grades in Group ‘C’ and promotion to Group ‘B’ Non-gazetted, and both carry same Grade Pay, for them this clarification will be applicable. Becuase the Grade Pay is not changed though the grade is changed with higher responsibility, so the clarification 2 states that when the Grade (NOT GRADE PAY) is changed the FR 22(I)(a)(1) will be applicable.

    Dear KMurthy,
    In my opinion, the clarification clarifies that even those who got ACP (old scheme)in between 1.12006 and 31.18.2008 are to be fixed in the pay of their higher post. That is both those who got promotion as well as those who are granted with ACP will get fixed in the pay of their promotional post. Then it further says that they can opt fixation either on the date of their promotion or on the date of their increment. Then it explains with example how to calculate such fixation.
    But the issue is wrongly dealt in the issues before the MACP anomaly committee.

    Sir, I have joined CSIR in 1988 as cost accounts clerk ( Isolated cadre) in the pay scale of Rs 4000-6000. I was promoted to Rs 5000-8000 scale in 1999 as per the Isolated category scheme viz., once in 11 years promotion. During the 6th pay commission CSIR merged my Rs 5000-8000 scale to Rs 9300-34800 scale with GP Rs 4200 from 1-1-2006 and given Assistant F&A Cadre which is a regular Administrative post.
    Now the question arised. Whther I am eligible for MACP. Sir I have served 22 years in CSIR and got one promotion only. Now the question is I have served 6 years from 1999 to 2005 in Insolated cadre and from 1-1-2006 till now in Administrative cadre. Also CSIR has closed my Isolated cadre by putting in GB. Kindly reply whether I am eligible for MACP as I served for 11 years without any promotion.

    As you have completed 20 year as on 2008 (from the dt and month) and got one promotion only ( from GP 2400 to 4200) you will get 2nd MACP with GP 4600 from that date of completion of 20 years or from 1/9/08 whichever is later.

    after implementation of macp, Training Officers’s of DGET (Directorate General of employment & training) under Ministry of Labour & Employment, Govt. of India, who had completed 24 year service before 01.09.2008 are getting Rs 5400 Grade Pay as 2nd ACP whereas after 01.09.2008 the Training Officers’s are getting Rs. 4800. After completion of 30 years service they will get Rs. 6600 Grade Pay (macp III) and we will get Rs. 5400 grade Pay ( macpIII). In the same post with the same duties and responsibilities, Grade pay’s are different.Alas!What a beautiful carrer progression benefit we are getting!The only way to solve such type of anomaly in grade pay in the same post of Training Officers’s of DGET is placement in the Grade Pay of the Promotional Post instead of next higher Grade Pay in the hierarchy of revised Pay Band and Grade Pay.Kindly look into yhe matter and remove the anomaly.

    Sir, i got selected as chargemen(group B non gazited) in indian ordnance factories…my pay scale is 9300-34000 with a grade pay of 4200….i want to know that how much amount they pay when i joined the service and when i can get promotion..what will be the pay when i get promoted…please give a reply.

    satish 9300 +4200 is your starting pay. On the date of your promotion your get 4800 + one 3 increment.
