Promotion without pay hike – Is it honorary?

A promotion unless to a honorary posting, should fetch some monetary benefit to the employee.  But it’s no so after implementation of Sixth Pay Commission report.  You would get a promotion and yet you are not sure of receiving any pay hike.

I feel this disorder has been caused not because of the government orders but the wrong interpretation of the same.  It is causing considerable financial loss to certain employees in the form of denial of increment at the time of promotion.

This is the Audit Observation of SRU and PAOs that causes the problem:

“As per Rule 13 of CCS Revised Pay Rules 2008, fixation will be done only in case of promotion from one grade pay to another in the revised pay structure. As such, no fixation benefit in the form of increment equal to 3% of Pay Band +Grade pay should be allowed where there is no change in grade pay due to promotion.”

The cadres affected by this wrong interpretation are :

Case 1: When Superintendents who got the grade pay of Rs.5400 as on 1.1.2006, are granted ACP to the pre-revised scale of 8000-14000 from the pre-revised scale of 7500-12000, pay fixation with 3% increment is denied to them, on the notion that it is only an ACP to the next grade that carries same grade pay.

Case 2: Administrative Officers promoted from DOS cadre, DOS from STA cadre, Inspectors from STA cadre, and Havildars promoted from Sepoys cadre have been badly affected by this wrong interpretation.

Case 3: A Deputy Office Superintendent after completion of service of more than 18 years, which includes the service of a decade or more in the junior cadres like TA/STA/UDC/LDC etc, is promoted now as AO and transferred  from one end to the other end of the State.  Do you how much his pay hike will be for this promotion? A Big Zero !

Case 4 : So is the case of a Senior Tax Assistant  who has been promoted as Deputy Office Superintendent and under the orders of transfer from one end to the other end of the State without any change in his pay as a result of the promotion.

A close look at Rule 13 of CCS Revised Pay Rules 2008, that provides the procedure for fixation on promotion after 01/01/2006 could throw some light on this issue.

“ 13.fixation of pay on promotion on or after 1.1.2006- in the case of promotion from one grade pay to another in revised pay structure, the fixation will be done sa follows:-

(i)  one increment equal to 3% of the sum of the pay in the pay band and the existing grade pay will be computed and rounded off to the next multiple of 10.This will be added to the existing pay in the pay band. The grade pay corresponding to the promotion post will thereafter be granted in addition to this pay in the pay band. …”

The portion where the audit team got stranded was put in the bold letters above, viz.,  Promotion from one grade pay to another “.  However they have not given attention to the clear wordings under the same Rule (i) which is also put in the bold letters above – “the Grade pay corresponding to the promotion post”.    At the time of release of 6CPC notification itself we discussed the adverse effect of this Rule in GConnect, especially in the case of uneven merger of three or four non-gazetted and gazetted cadres under one Grade Pay.

By understanding the field level problems, a Clarification was issued in OM No.F. No.1/1/2008 IC  dated 13/09/2008 by the Government which reads as follows

“Clarification 2: The method of fixation of pay on promotion after 01.01.2006
On promotion from one grade to another/financial upgradation under ACP, a Government servant has an option under FR 22(I)(a)(1) to get his pay fixed in the higher post  either from the date of his promotion, or from date of his next increment, viz. 1st July of the year. The pay will be fixed in the following manner in the revised pay structure:-
(a)  in case the Government servant opts to get his pay fixed from his date of next increment, then, on the date of promotion, pay in the pay in the pay band shall continue unchanged, but the grade pay of the higher post will be granted…”

The words coined under Rule 13 as “Promotion from one Grade Pay to another”  has been changed in the form of clarification dated 13.09.2008 mentioned above to the extent that “On promotion from one Grade to another grade”,  to rectify the mistake that is causing the pay fixation problem we are discussing so far.  So, if an employee promoted from one grade to the other, he is entitled for pay fixation with an increment of 3% irrespective of the fact that both the grades from and to which the employee was promoted carry same grade.

With the clarifications issued further by the Government, even the very little ambiguity that prevailed has been sorted out now. Thus the audit /SRU teams are to review their stand on this issue.

If the audit/SRU teams and PAOs are still persisting with those 7 words i.e. promotion from one grade pay to another, following fundamental things are under Question.

What will be the use of forming a DPC for promotion, if no pay benefit accrues to the promoted employee?

What is the fun in shuffling the employee across the State in the name of a promotion without any pay Benefit?

    I fully agree with the author.  But the pity is that the PAO’s are very adament and not yielding to any request for reconsideration.  As the old adage says “Its easy to wake up the sleeping one but it is not so easy to wake up the one pretending to be sleeping”.

    It is rightly observed by the Gconnect team. This clarification must be given stress from all the sections of the employees who have been promoted with Pay Benefit on or after 01/01/2006. I had been promoted as OS Gr-II from 5000 – 8000 scale to 5500 – 9000, but was not given pay benefit. Now, based on the above lines, I plan to give a representation to the Administration, Hope it works.

    s im also agreed wth author, im working in railways, due to merging of caders, while taking promotion,(frm one cader to othr cader which are in same grade pay) employee doesnt get any financial benfits, even a single increment also, but employee hav to look higher responsbulties, it is injusties

    A good analysis by Sri.LN. Such promotions are there in every dept. I am one of them, working as a Primary teacher, accepted promotion as TGT and started teaching with heavier responsibility of teaching X std. Since I was a PRT in Chennai and accepted promotion outside Chennai, after the VI CPC, as there is not even a single paisa increased from the pay there is net loss of more than Rs.5000 p.m including allowance loss. Truly in the holy profession doing honorary work. How is it? Will there be a way out? or to go on reversion.

    sir, i fully endorse the view. Promotion means from one lower pay to another pay and provide more power in the existing hierarchy  . as govt.servent was given MACP the govt. wants to reduce some benefits given them earlier. as govt. first wrongly clubbed C&B and increased the GP for 6500-10500 scale this will also be changed or let us hope so.Thanking you, yours sincerely,V.Padmanabhan , VCRC, Pondicherry

    I fully agree. The seniors are badly affected even after getting promotions sometimes gettting lesser pay with juniors below one grade… very pity. This should be looked into immediately all concerned.

    One illustrative example for consideration. (1) A senior person gets promotion after 9 years and gets higher grade pay along with increment. (2) Another person (who is just junior to the first person) completes 10 years, gets ACP with higher grade pay and increment, subsequently gets promotion immediately, gets another increment. The junior will now draw higher pay. Hence PAO does not agree for double benefits.

    I have some doubts for clarification. (1) Suppose one person gets promotion after 9 years of service, he gets 3% increment and higher grade pay but he is not eligible for MACP after completing 10 years of service. (2) One junior gets MACP after completing 10 years of service with 3% increment and higher grade pay. Suppose he gets promotion shortly afterwards, if he gets another increment he will draw more than his senior. Am I correct ?

    I had given a representation today to my Administration. They said they look into the matter. I hope this works out. The clarification No 2 issued by the finance ministry dated 13/09/2008 clearly states how the pay has to be fixed from ONE GRADE TO ANOTHER. The same point is stressed in the MACPS order Para 2 and Para 7. I expect a favourable order.

    I am t p balaji, inspector (promoted from deo-sta on 04.11.2006) and thank you very much for the valid points you made and wonderful clarification (which are always not accepted by the PAO Staff and even some of our officers also) regarding the no increment on the promotion in the same pay band and grade pay. The same may be taken for consideration and the department may give a standing clarification to the PAO Office regarding this issue. Hope for the remedy as early.

    Further, I have to put a question / clarification regarding the 4600 grade pay recently sanctioned for the pre-revised scale of 6500/-.     Mr. V. Ramkumar, u r not correct. The second person will not get increment on promotion. He will get the GP of the promotion post, if it is different from the MACP Grade. If the GP in the MACP Grade and Promotion grade is same, he will not get any financial benefit. Only the designation changes. So there will be no problem as u fear

    100% agreed. all the blame falls on the new system of grade pay. earlier system of pay scale was much better. more the simplicity sought, more the complex nature of anomalies found in the revised system.

    You have aptly described the cursed fate of the DOS in the Central Excise Department. 
    I joined this dept. as a Direct Recruit UDC appointed by the SSC in 1994.
     I am a graduate, also possess a speed of 100 words per minute in shorthand, and a higher grade in english typing.  
    By the name of cadre restructuring I was given the designation of TA and then a STA.  Now by the name of filling up a vacancy I was given promotion notionally w.e.f. 31.03.2003.  which is of no use monetary wise and function wise.  
    Due to lack of height alone i was declared unfit for promotion to the grade of Inspr.
    But all my juniors who joined the dept as UDC during 1998 got promoted as Inspr. Now due to this pay commission, i have been even degraded by the rule that promotion from STA to DOS does not imply a pay fixation.  

    Now i am drawing pay very much lower pay than my juniors just only because of the injustice done by the dept. and the pay commission.

    The post of DOS is a supervisory cadre and moreover we are the reporting officers for a set of staff working under us. 

    I am ready to join with u sir in any movement to acheive equality in pay on par with the Insprs, of Central Excise.  We are in no way less abled than that cadre.  We are the supporting pillars of the Administration side on which all the officers are dependant. 

    We must rise in this occasion and demand for justice and equality.

    I am also promoted from 5000-8000 to 5500-9000. There are many like me in our office. But I have not got any benefit. But if I give any representations now will it be considered. Since, they have given one month’s time to give option for pay fixation and that time is over. We have not thought at that time. Can I give now.

    Dear all,
    after evey pay commission recommendations, a large number of such anomalies do arise which clearly reflects that the members and associate staff are either ignorant or not serious as they woud have definitely ensured every benefit for themselves. Commissions are usually constituted to favor a few people of the govt.’s choice so that they can enjoy for a period not only positionally but also monetarily. The govt. should seriously consider everything before implementing any recommendation. Further, granting more benefits like creation of a Post called PSO just to appease a particular cadre, when others are deprived of their due benefits. It is time the govt. understood that disparity in any form and withholding due benefits to govt. employees would result in dismal performance and corruption as well.

    For Supdts. who are awarded NFG Scale of PB.2 Rs.5400 GP on 1.1. 06 and also awarded 2nd ACP after 1.1.06, they are required to be placed in P.B. 3 with GP Rs.5400/- even under the provisions of Modified ACP, not withstanding the legal status of being governed by the provisions of earlier ACP, as modified ACP recogonizes PB3 Grade Pay of Rs.5400/- is a different grade pay from for the purpose of ACPs. Therefore, fixation of pay and 3% increment is allowable.

    right observation sir!
    I am one of the victims to this rule. I was in 5000-8000 pre-revised grade and got notional promotion from 01-01-2006 to 5500 grade, but, without any monetary benefit. Another funniest thing is that I am due for MACP [10 years] from June 2009 and due to my promotion on 1-1-06 I may not get MACP and the monetary benefit that linked with MACP too! Absolutely in confusion, fighting with Govt – will it yield any results now a days?

    just on the wording of the orders and not understanding the true meaning “bhavna” of the same is a regular mind set up of PAOs and even DDOs. Ist they denied ACP to INspectors of REvenue department of Rs.4800 during jan 96 to Aug 98 and later on accepted. They always denies step up of pay and later on accepts. It is their mind set up to misinterpetate the Rules to deny benefits to employees. The Pay & Accounts Officer, Customs, New Delhi is not allowing change of option whereas orders have been issued by government to allow option to change option for pay fixation when the pay scale of Inspector/Supdt was enhanced w.e.f. 21.4.04. The orders to change the option have been given in 2006, Jan 2009 and in recent orders while giving Grade pay of Rs.4600 to pre revised 6500-10500. It means that option once given is not final it can be changed later on if is not benefecial to government employee. Every employee cannot understand the method of option. Therefore option once given should not be treated as final.

    THE DY OFFICE SUPDT OF CENTRAL EXCISE HAVE BEEN PUT BACK WITH SR. TAX ASSISANT. WHY WILL THEY WORK PUTTING THEIR EXPERIENCE FOR GOVT. THEY WILL WORK ONLY AS A NEW CLERK. THIS IS IST PAY COMMISSION WHERE HIGHER POSTS HAVE BEEN MERGED WITH LOWER POSTS. THE PAY CLERKS SHOULD BE THE MEMBERS OF PAY COMMISSION BECAUSE THEY UNDERSTAND THE ANOMOLIES BETTER THEN OFFICERS. A OFFICER NEVER UNDERSTAND THE PAY RULES. WHY SO MANY CLARIFICATION AFTER VITH PAY COMMISSION. BECAUSE IT IS TOTALLY FAULTY AND NO CARE HAS BEEN APPLIED WHILE FRAMING IT

    Hi, There are so many members who got promoted from the post of Sr.TA to Office Superintendent during the period 1.1.2006 till the date of notification of the Sixth Pay Commission, under the ealier pay scale, who have now been clubbed in the same grade pay of Rs.4200, and have been denied the benefit of pay fixation.
    This problem requires to be looked into.

    the misinterpretation prevails everywhere regarding MACP. there are so many anomalies arising out of fixing the eligibility of the employees.once ACP is granted the employee has to wait 10 more years for further promotion. if any regular promotion achieved by the employee it will not forgo his subsequent ACP which is due. in this area most of the personnel officers denied to understand the fact there no restriction in giving the number of regular promotions in the span of 30 years where as the ACP s are three. how to solve this

    I am eligible for NFSG w e f 1 1 2006, whereby my grade pay is fixed in PB-2, 5400, w e f, May 2007 I had been granted ACP as per the provisions of the instructions on the subject, I should be granted pay band PB-3 with GP @ Rs 5400.The instructions as per the MACP also, the position is very clear. However some prejudiced minds of the DDO and the PAO are denying me and similarly placed officers the benefit legally due. From my experience I have noted that most DDO’s simply adhere to whimsical instructions of the PAO without ascertaining the correct position or to substantiate the PAO’s audit with the relevant rules or instructions.I am yet to draw my 60% arrears due to me.

    Yes. i fully agree. this is a great injustice. The Govt. should look into once again and to remove hierarchy system of giving grade pay on promotion or ACP and to be introduce as hierarchy in cadre wise grade pay of that department on ACP or on promation. There should not TWO system of fixing grade pay ONE DURING ACP and OTHER DURING ON PROMOTION. THIS IS CONTRARY TO EACH OTHER.

    while working as accountant in ag’s office, i was promoted as assistant audit officer on 2008 after passing soge examination. The promoted post happens to be two posts higher to the post i was holding at the time of passing the exam (above sr. acctt & section officer posts). however when my pay was fixed only 3% increment + the grade pay corresponding to the promoted post was given. sixth pay commission thereby gave no respect for soge exams and those who worked very hard to get through the once prestigious exams.

    goverment has recently issue the order for grade pay ugration from 4200 /- to 4600/- for the pre-revised pay-scale 6500-10,00, i want to know wheather it is applicable to those who got A.C.P. 5500-9,000 scale to 6500 -10,00 before 1.1.2006 & pay fixation will be done accordinlgy. Please carify

    Yes. OM says those who were in the pre-revised scale of Rs.6500 as on 1.1.2006 are eligible to receive grade pay of Rs.4600. In that case it is also applicable to persons who attained the pay scale of Rs.6500 as on 1.1.2006 by way of ACP

    I HAVE TAKEN TWO PROMOTIONS IN 1985 AND 1997. IF MACP IS GRANTED TO
    TO ME I AM GOING TO GET GRADE PAY 5400/- W.E.F 1.9.08. WHAT BENEFIT I AM GOING TO GET ON PROMOTION? WHAT IS ;THE RIGHT CHOICE OF OPTING FOR
    FIXATION OF PAY FOR REGULAR PORMOTION? DATE OF PROMOTION OR JULY2010? KINDLY LET ME KNOW?

    I was promoted as Section Officer in O/of IA & AD on 14.8.02 in the payscale of Rs.6500-200-10500. I am due to get promotion as Asst. Audit Officer on 13.8.05 (after completion of 3 years) but as a policy of decision promotions are considered only on 1st January, I was given promotion on 4.1.2006 (orders were issued only on 2.1.06). On 1.1.06 I was drawing pay of Rs.7100 in the old scale and my pay was fixed at Rs.13210 and no increment was given on account of promotion (either on the date of promotion or on 1.7.06 )as both the SO and AAOs scale has the same grade pay. Can I represent?

    Due toabsence of 5th CPC Pay scale 16500+(6th CPC 34700+Grade Pay 8900) in the IAS/IRS/IA & AS cadres,where in officers getting promotion from 34700+GP 8700 to 34700+GP 10000),promotional avenue of Group B officers are get stagnated at the 5th CPC scale 8000-13500 which created such problems that three posts carrying same grade pay of 5400.(AO,SAO and on promotion to junior time scale of organised Group A posts),as the pay of(PB/GP)of all posts in the central services has to carry lower PB/GP of their Civil Service(UPSC) entry cadre . This can be soved by upgrading NFSG of group A category from GP 8700 to 8900 and introducing two GPs for the first two grades of JT Scale(JTS and time scale of JTS) .Example- Assistant commissioner of Central Excise PB-15600 with GP 5400 and selection grade of Assistant commissioner of Central Excise PB-15600 with GP 6600(prsently Dy.Comm).If above proposal can be considered Suptd can be given GP 6600.On promtion from Supdt to Asst.Commissioner they can be placed as Selection grade Asst.Commissioner with GP 6600.Govt.is not going to have not much financial burden due to above as number of orgainsed group A posts in the Central services with GP 8900/- is not much.

In a system, where all posts are through selection process via interview (internal plus external), does the provisions of promotions apply to internal candidates? I have heard a composite method of selection wherein for internal candidates it is promotion but for external candidates it is direct recruitment. Is it true?

    the grade pay of Tax Assistant should be upgraded from 2400 to 4200. TA and STA do same nautre of work, therefore TA & STA posts may be merged and all STA may be upgraded into Inspectors or DOS

    My friend is working as Audit Assistant (Group C) in Regional Office in the pay scale 5500-175-9000 and got ACP in the scale of 6500-200-10500 in 2005. Now in VI pay commission the grade pay for both scales was 4200. But as per new OM he will get the grade pay of Rs.4600/- for the ACP scale of 6500-200-10500.

    Recently he has got promotion through Limited Departmental Examination of Office Supdt. (Group B) having grade pay of Rs.4200/- in Residential Schools.

    If he joins the post of Office Supdt. in JNV, whether he will get the pay protection of old scale? Also whether his grade pay of Rs.4600/- will protected or not? Please comment on this issue.

    (1) Whether an working employee as Sr. PS in lower scale qualify UPSC Exam and joined in higher rank as Assistant Registrar in ITAT in the pre-revised scale 6500-10500 which was upgraded 8000-13500 later on, is eligible for PB-3 with Grade Pay 5400 or PB-2 with grade pay 5400. (2) An employee working in lower scale as Superintendent or Hindi Translator got departmental promotion as Assistant Registrar in ITAT in pre-revised scale 6500-10500 which was upgraded 8000-13500, is eligible for PB-3 with Grade Pay 5400 or PB-2 with grade pay 5400.

    Some of my LDC friends of Kendriya Vidyalaya Sangathan qualified the open test of KVS for the post of UDC and joined last year i.e. 2009. As they have completed more than 16 years as LDC and already got the ACP in the scale of Rs.4000-6000, no further fixation was done for the post of UDC.

    Kindly suggest/inform when they will get their 2nd ACP and which rule will be applicable for them as 2nd ACP is due after 04 years and they are working in the same department i.e. Kendriya Vidyalaya Sangathan.

    I am a direct rect SO in IAAD in 2003. the post got upgraded w.e.f 1.1.2006 and merged with AAO with grade pay of 4800. i will get ist MACP in 2013 of 5400, IInd in 2023 (again with 5400 of PB-3)…??? i.e. if there is no regular vacancy for AO/sr AO, from 2013 to 2023, promotion with no increase in Grade pay?? 5400 to 5400? again, for induction in IA&AS cadre, age bar of 53 years is there to prevent young and experience official to go into IA&AS. is it justified? is this Minimum Assured Carrear Promotion scheme ? is governemnt hearing??
