Grade Pay of ACP Inspectors – Follow up

In continuation of my earlier article on the grant of Grade Pay of Rs.4800/- to the Inspectors of Customs and Central Excise, who are in receipt of ACP between 01.01.2006 to 31.08.2008, I am obliged to let the members aware of the further developments on this issue.

The Principal CCA in his letter No.Coord/Exp/G.P/2008-09/93 dated 31.07.2009 has stated that the cases of ACP may be finalized according to the provisions contained in O.M.No.35034/3/2008-Estt (D) dated 19.05.2009 issued by the DOPT on the subject of MACPS for the Central Government Civil Employees.

However, the PAOs all over India have not taken into cognizance of the above letter and continued to grant the Grade Pay of Rs.4600/- to those Inspectors on the pretext that there was not any specific mention by the Pr.CCA to grant the Grade Pay of Rs.4800/-.

The All India Central Excise Inspectors Association relentlessly took up the matter with the CBEC on account the fact that the issue have not been resolved by the obstinate attitude of the PAOs after the clarification issued by the Pr.CCA on 31.07.2009.

The Board in F.No.26017/83/2009-Ad.IIA dated 24.09.2009 in response to the representation of the AICEIA, have indicated that the Pr.CCA’s letter dated 18.05.2009 instructed all the PAOs to reopen the cases of grant of ACP during the 01.01.2006 to 31.08.2009 which is against the very spirit and essence of the OM issued by the DOPT on MACPS and that the entire issue is in consonance with the OM dated 19.5.2009.

Further, in the letter referred above issued by the Board, it was also requested to withhold the recovery and to instruct all the PAOs under CBEC not to effect any recovery from the Pay and Allowances of the officials concerned.

Based on the above said letter, many PAOs have granted the Grade Pay of Rs.4800/- and did not recover any amount from the Pay and Allowances and the Second Installment arrears of the Sixth CPC.
However, some PAOs are still refusing to grant the Grade Pay of Rs.4800/- on the pretext that they have not received any communication from the Pr.CCA in this matter.

It is apparent that any instructions issued by the CBEC to the Pr.CCA will bind the PAOs in respect of the Pay and Allowances of the staff working under CBEC. To add insult to the injury, some PAOs have even made recovery from the Second Installment arrears of the Sixth CPC.

Who is to be blamed for these unsavory developments? Should we blame the CBEC for not clarifying the issue unambiguously? Is Pr.CCA responsible for these developments, for not instructing the field formations with proper clarification? Or should we blame PAOs in field formations who are expecting the Pr.CCA to clarify them individually?

    It is a fact that the Officers in CBEC have to depend more on the attitude of the PAOs than on the Government Orders which do not clarify all the needle of doubts at one go instead the Government Orders encourage the PAOs seeking clarifications as many times as possible without adhering to any time limit to the implementation of the Government Orders.

    I fully agree with the view. In bangalore, PAO of each Commissionerate has adopted a different view. The PAO of LTU has granted Rs.4800/- grade pay where as, PAO’s of Bangalore-I,II, III and Customs Commissionerate have effected recovery and have granted only Rs.4600/- Grade pay. I have heard that Inspectors working in DRI, Bangalore and thoe in Mysore Commissionerates have drawn Rs.4800/-. We are literally at the mercy of the PAO’s. Associations are claiming to have spoken to the respective PAO’s but again it is going to be a endless wait.

    tHE GRADE PAY OF CBEC INSPECTORS SHOULD BE REVISED LES WE ARE NO THING BUT JUST AN EXECUTIVE TAX ASSISTANT . SINCE 6TH PAY COMMMISSION WE ARE MADE EQUIVALENT TO THOSE LOWER GRADES . THE GARDE OF SUPERINTENDENT WITH GP-4800-5400 SHOULD BE JUST ABOVE THE INSPECTORS’ GRADDE PAY WHICH IS 4200 – WHEN THERE IS NO PROMOTIONAL GRADE BETWEEN THESE TWO WHY SHOULD THERE BE A GAPE OF GRADE PAY BE TWEEN THESE TWO. THE NEED TO UPGRADE CBEC INSPECTOR GRADE PAY MUST BE TAKEN SERIOUSLY AND HIGHER PAY GRADE OF ATLEST 4600 MUST ME GIVEN- IF NOT WE ARE BEING HUMILIATED AND THE POST IS NOW DISRESPECTED BY OTHER LOWER POSTS – NOT ONLY THE ACP SHOULD BE TAKEN INTO DISCUSION THE NEW ENYTRANT PAY GRADE SHOULD ALSO BE SEEN.

    I think CBEC officers are always using the however clause to shirk responsibility. When the DOPT order is clear why can’t the CBEC point out that the view of the Pr CCA/ PAOs is wrong in toto

    at last pao can not logner have any excuse. the grade pay of inspect5ors have benn gaanted wie.f. 1-1-06. and let them be happy that they have stood their ground .

    orders have been issued granting 4,600 /- to all who were in 6500-10500 on 1-1-06.

    hats off to the relent less efforts of central revenue co-ordination commitee.

    Dear friend, Congratulations on acheiving 4600 grade pay in the 6500 basic. Pl workout for 5400 grade pay for the inspectors who have completed 4 years in the grade pay of 4800. Hope the same will be considered by the authorities.

    Congratulations to Babus of ministry of expenditure for understanding the recomendations of 6th pay commission at least in one year. Now I request them to again study ‘ACP’ Rules effective upto 31.08.2008 and grant Grade pay 5400 to those Inspectors who have completed 4 years in grade pay 4800 (scale 7500-1200) before 31.08.2008. They may take the help of Babus of DOPT.

    the problem is that the person who prepared the pay bill says that basic will be 9300+4600=13900 but according to the govt. order if the grade pay is 4600 then pay in the pay band will be 12540, then basic becomes 12540+4600=17140.
    i m confused. plz some one help me out of this confusion.

    Dear Friends- Hi, I am Inspector in CISF, which is a paramilitary force, Ministry of Home affairs, we dont have group B post. An Inspector get promoted to the Rank of Asstt. Commandant which is a group A post. I would like to ask if under new ACP Scheme, the grade pay should be 5400 or 4800? Please keep in mind that we dont have group B post in CISF. Please offer your expert comments. Regards

    Dear friend , As far as I know being in org. Inspector is Group B post in CISF however it is not Gazetted.

    As on 01-01-2006,my Old Basic pay was Rs.6700 and grade pay @ Rs.4200 has already been fixed as Rs.16670 as New Basis Pay w.e.f. 01-01-2006. But the Grade pay has been revised @ Rs.4600 vide F.No.1/1/2008-IC dated 13-11-2009 issued by Alok Saxena, Director, Ministry of Finance, Dept. of Expenditure, Implementation Cell. What will be my new Basic Pay w.e.f. 01-01-2006 in the Grade Pay of Rs.4600?

    to karina, for fixation they have follow the Illustration 4-A for pay fixation. it can not be less than 17140 as on 1-1-06 and if it is less than that and new appointee gets more pay than that you will have option of anomoly.

    to havidner singh cisf inspector.

    if you are eligible for ACP prior to 1-9-08, then you will get the benefit as per old scheme. if you become eligible
    as per new MACP scheme, then your grade pay will get upgraded to next grade pay inthe pay band. i.e if you are in 4600/- then you will be upgraded to 4800/- and on promotion fixation benefit and if grade pay is different then the apprpriate grade pay.
