This an order issued by Haryana Central Excise Commissionerate for fixing the grade pay of an Inspector who has received ACP. Based on the clarification dated 30.10.08 issued by Ministry of Finance, the grade pay has been fixed rightly at Rs.5400/-. We feel this order could be cited by other Inspectors (ACP) belonging to Customs, Central Excise and Income Tax for getting the grade pay of Rs.5400/-

Please clarify the date of joining of Shri Manjit Singh, Inspector, Date on which 1st ACP was granted, whether if 1st ACP was granted on Sept 2000 that in such case whether I will be eligible for Grade pay of Rs 5400 w.e.f 1-1-2006. I am an Inspector of Mumbai -II commisionerate, joined in Sept 1988 as direct inspector and still an Inspector drawing grade pay of Rs 4800. Please reply immediately. Any collegue having any idea please guide

In Mumbai -II commissionerate they have fixed Grade pay as Rs 4800. I am inspector of Sept 1988, Got 1st ACP in Sept 2000 and my basic as on 1-1-06 was Rs 8750 what should be my Grade pay and pay fixation as on 1-1-06. Please guide me whether eligible for gr pay of 5400 if so from which date. Thanks

It was expected, no sooner or later this would be given. It is a very good relief to all the Inspectors who are waiting for this orders.
Badri sir.. This fixation is done basing on the circular issued after clarifying from Deportment of Expenditure, I hope this will hold good.. your comments please?

Your case is clear. you should get 5400/- from 21.4.2008, as the scale of Supdt. is upgraded to 7500/- from 21.4.2004 and I hope your case also it was done on the same date. Here in Hyderabad there is no Inspector with ACP who has completed 4 years in 7500/- scale but, all the Supdts are given 5400/- from 21.4.2008.
In the case of Mr. Manjit Singh his date of joining would be 27.8.1992 and ACP on 27.8.2004, therefore 5400/- is on 27.8.2008.

In our Commissionerate (Mumbai V) inspectors of 1992 batch have still not got the grade pay at 5400. In fact the administration is still pondering as to whether the clarification dt 21.11.2008 issued by the ministry pertains to Non gazetted Group B officers at all. Here people are interpreting as if that particular clarification was only pertaining to Superintendents and to know how the four year period is to be counted i.e the date of placing the officer in 7500 scale or 01.01.2006. It is sad that there is no uniform interpretation of the clarification issued by the MINISTRY. It appears that there should be DIRECTIONS from the ministry to settle the issue once and for all. Hoping for the best.

After implementation of 6cpc report the future of directly appointed Inspector in Central Excise department has become bad to worst. Generally , one LDC becomes Superindent with minimum 4 promotion in his/her entire career, other hand one AC usually becomes Chief Commissioner with minimum 4 promotions. It is pathetic to say that there is neither examination nor promotion prospect for the grade of direct recruited Inspectors and they maximum got only one promotion upto superintendent generally.

The Inspectors of 92 batch got Grade pay 5400 after calculating 4 years from date of ACP with salary of December 2008 in a number of commissionerates like, Ranchi, Jamshedpur, Patna, Patna(Customs preventive) and more after Board Clarification

The inspector (ACP) of 92 batch & earlier batches & even Superintendents also did not get Grade Pay of Rs 5400 till now in Pune excise & customs Commissionerate. Authorities are not taking clarification seriously issued by Government. How the officers of Pune Commissionerates can get Grade Pay of Rs. 5400/- . Can anybody explain.

In Tamilnadu, even Superintendents with 4 years of service as on 21.04.08 have not been given grade pay of 5400/-.Only Superintendents who got their second ACP are drawing 5400/- GP

I AM GROUP B (G ) OFFICER IN THE I & B MINISTRY. MY EXISTING BP IS 7500-250-12000 ,.THE 6 TH CPC FIXED GP RS= 4800/=ONLY W.E F 1.1.2006 . BUT I HAVE COMPLETED MORE THEN 4 YEARS IN THE SAME BASIC @ 7500-250-12000.WILL I GET THE GP RS=5400. KINDLY TELL ME.

I like your optimism but the reality is that the recommendation of the 6th CPC in respect of the Department of Revenue are that those officers who are officiating as Superintendents of Central Excise, Superintendent of Customs, Income Tax Officers, and Appraisers and who have been in the scale of pay of 7500 – are eligible for Non functional upgradation to Rs8000 scale and the corresponding GP of 5400/-. Inspectors with ACP are NOT Superintendents /ITO / Appraisers and hence are not eligible for 5400/- in terms of 6th CPC. However, the Inspectors could explore the possibility to get the same through the ACP mode. Instead of getting ACP in the GP hierarchy, we should insist on Cadre based GP i.e., Inspector to next cadre Superintendent, etc.

Dear Richard, there is no word like officiating in the ^PC as you used in your quote. The resolution of 6PC tells that Gr ‘B’ officers of Deptt of Revenue like Supdts Appraisers and ITOs etc for the benefit of GP 5400 after 4 years. would get GP 5400 after 4 years of service. As per DOPT, Inspector is also Gr ‘B’ officer and can be taken as covered in the word of ‘ETC’ for the benefit of GP 5400 after 4 years. Please wait till the correct analysis of the Resolution of 6PC and Resolution is above all orders/notifications of DOE or DOPT in the service matter of any employee which is a settled fact on the basis of various judgements of CAT/Courts.
