Clarification on grade pay of Rs.5400 to Group B Officers in CBEC

In line with the clarification issued by CBDT, Central Board of Excise and Customs has now issued clarification on grant of grade pay of Rs.5400 to Group B Officers in Central Excise and Customs

As per this clarification Group B Officers of CBEC, who have completed 4 years of service as on 1.1.2006 are entitled for grade pay of Rs.5400/- in PB-2 with effect from 01.01.2006.  Earlier, these officers were given this non-functional upgradation only from the year 2008 on the notion that the pay scale of Rs.7500-250-12000 was attained by these Officers only during the year 2008

It was also clarified that the non functional grade pay of Rs.5400 in PB-2 will not be granted to Group Officers who have got the grade pay of Rs.4800 on upgradation under the ACP Scheme.

  1. This is Ridiculous. On the one hand Inspectors of central excise are group B officers and yet grade pay of 5400 is being denied to them after completing four years after acp. What a shame.

  2. The Govt. resolution speaks only regarding group B officers placed in the payscale of Rs. 7500-250-12000 and the completion of 4 years in that pay scale. The Deptt. of Expenditure was not able to interpret the effective date initially and denied the benefit to everyone till 2008 and even now they have stuck to their guns and have denied the benefit to ACP inspectors. I think that the Deptt. of Expenditure is full of sadists who get great pleasure in denying the officers their due! I hope this issue is still there in the discussions being held between our association and the Board, as the website of the association does not contain any updates regarding the same. is there any news regarding the case filed in Eranakulam CAT on this issue?

  3. Why upgrade officers who got promotion within 10 years of joining service whereas not upgrading officers who have completed 22 years are due for the second ACP as per old rules. Refers to Income tax inspectors, Preventive officers, Examiners. Why the excise inspector should suffer. This is draconian interpretation.

    The non-functional upgradation to the Group ‘B’ officers, who have served as Supdts for 4 years, if applied only to the functional superintendents, will not serve any purpose as most of the supdts. working presently have earned their 2nd ACP (on completion of 24 years of service) or would be eligible for 2nd ACP under the revised MACP (on completion of 20 years of service). Even the long-standing Inspectors (awaiting promotion after completion of more than 18-19 years of service) would be eligible for 5400 grade pay under the revised MACP. I think the intention of the upgradation is not to deny the 5400 grade pay to others if it cannot be applied to most of the Group ‘B’ Officers. The underlying cause is ‘acute stagnation’ which has to be addressed to by the people at the top. If this is not attended to on a war footing, the senior officers(both Supdts and Inspectors)will suffer double jeopardy of denial of career progression and pay upgradation vis-a-vis other junior officers getting early promotion and pay upgradation. Everything else will settle down if the grievences of the cadre are redressed properly. With best wishes,

  5. Well, you cannot compare Customs and Income Tax with Central Excise. In Income tax and Customs, they get promoted from Preventive Officers to Superintendents and from Inspectors to Income Tax Officers in max 12 years. In Central Excise, it takes 17 years for General Candidates and 16 for SC Candidates to get promotion, hence, if seen the 4 years would be redundant for all inspectors promoted from the time MACP takes effect. This is because in 20 years they would have got 5400/- grade pay whereas the clause of 4 years would be completed only after gettting the revised MACP. The Board should have noted this and if required taken it up with the Pay Commission and issued orders in regard to ACP inspectors too.

    Hope all of you understand the problems of stagnation in Central Excise.

  6. It is not that the higher up in our Board did not under stand the issue properly. They do not want to consider the Inspector cadre as a Group B cadre but as a clerical cadre for reasons best known to them.

    On merger of three pay scales of 5000-8000,5500-9000 and 6500-10500 the pay has been ordered to be fixed in the existing scale with grade pay of scale of Rs.6500-10500,whereas the grade of pay for all the three grades is the same as 4200. So what benefit a person who is in the gr4ade of Rs.5500-9000 as on 01.01.2006 and merged with scale of Rs.6500-10500 has got nothing so what is the fun of merging the scales wef 01.01.2006,when no benefit has been given from 2006 to onwards.(II)The fixation of pay in the pay band 2 should be Rs.12090-34800 instead of Rs.9300-34800 with grade pay of 4200. Because when scale merger 5000-8000, 5500-9000,6500-10500) to be place then lower scale is always merged with the higher scale, that is 6500X1.86= 12090 instead of 5000X1.86=9300 and 5500X1.86 =10230. This is a serious anomaly and should be removed first hand to save those retired from service on 01.08.2006 onwards without getting any benefit of ACP or promotion. Thanks.   10. Apart from the point of acute stagnation the CBEC has put one more condition of “free from vigilance angle” for grant of 5400 GP, whereas, no such condition was prescribed in the CBDT letter. The reason for this differentiation between two similarily placed cadres cannot be understood from any perspective. If the condition of “free from vigilance angle” is applicable to CBEC then it should also be for CBDT. The action of CBEC and Deptt. of Expenditure can not be accepted and this conditon should be removed immediately.

But the DDO and PAO creates a problem everytime and the Pay fixation in Central Excise & Customs (after VI Pay commission) has been done four to five times in respect of Supdt. The PAO has directed to DDOs give grade pay of Rs.5400 to Supdt only w.e.f. 21.4.2008 and recoveries are also being done. What a joke

But the PAO, Central Excise, Delhi is denying stepping up of pay to senior on the plea that ACP is totally individual.   13. I Joined the Department in 1986 as Inspector. I have been granted Ist financial upgradation in August 1999 under ACP and have been promoted as Superintendent, Customs and Central Excise in October 2007. My grade pay is Rs. 4800/- w.e.f. 01.01.2006.

    I am due for second financial upgradation w.e.f 01.09.2008 as per the Modifled Assured Career Progression Scheme (MACPS). I am fulfilling all the conditions laid down in Office Memorandum issued under F.No.35034/3/2008-Estt. (D) dated 19.05.2009 of Government of lndia Ministry of Personnel, Public Grievances and Pensions, (Department of Personnel and Training), New Delhi.

    In this connection attention is invited to illustration given at para 28 (B) of the above referred Office Memorandum which is relevant in my case, which reads as under :

    “If a Government servant (LDC) in PB-I in the Grade Pay of Rs.1900 is granted 1st financial upgradation under the MACPS on completion of 10 years of service in the PB-l in the Grade Pay of Rs.2000 and 5 years later he gets 1st regular promotion (UDC) in PB-I in the Grade Pay of Rs.2400, the 2nd financial upgradation under MACPS (in the next Grade Pay w.r.t. Grade Pay held by Government servant) will be granted on completion of 20 years of service in PB-I in the Grade Pay of Rs.2800. On completion of 30 years of service, he will get 3rd ACP in the Grade Pay of Rs. 4200. However, if two promotions are earned before completion of 20 years, only 3rd financial upgradation would be admissible on completion of 10
    years of service in Grade Pay from the date 2nd promotion or at 30th year of service, whichever is earlier.”

    In my case, I joined as Inspector in direct entry grade on a regular basis on direct recruitment basis on 1986 corresponding to the revised grade pay of Rs.4200 in the pay band PB-II and granted 1st financial upgradation under the ACP on completion of 12 years of service w.e.f. August 1999 corresponding to the revised grade pay of Rs.4800 in the pay band PB-II and 8 years later I got 1st regular promotion (Superintendent) in PB-II in the same Grade Pay of Rs.4800 in October 2007, the 2nd financial upgradation under MACPS (in the next Grade Pay w.r.t. Grade Pay held by me) is to be granted to me on completion of 20 years ( w.e.f. 1986) of service in PB-II in the Grade Pay of Rs.5400/- w.e.f. 01.09.2008. The departments interpretaion is that I got two upgradations one under ACP and another as promotion. Can anybody through some light on the matter please.

  14. besides the normal procedure like sending representation to HPC/Board?ministry etc, to set right the Rs. 5400/- pay Grade pay issue, why cant we explore possibility of legal remedy, especialy when the issue croped up due to misinterpretation of the recomendations of 6th pay commission.

  15. Sir, while going through the letter dated 16/9/2009 received from the CBEC it has been noticed that the grade pay of Rs.5400 shall only be given after vigilance clearance. Sir, neither this is promotion nor ACP. Moreover there is no such clause in the letter issued by CBDT in the month of march, 2009 granting GP of Rs.5400/- to the Income Tax Officers. Then why this clause for the Superintendent Group B working under CBEC? This news is very heart burning. It should be rectified immediately.

  16. The govt. is very clever in giving the pay bands and grade pays. The plot to supress the cadre bagan from pay comm recommendations itself. They cleverly introduced gp 5400 in pb2 as well as in pb3. Once all others are given 5400 after 4 years in pb3 why only revenue & postal dept. is given in p5400 in pb2. In MACP memo they stated that the grade pay of 5400 in pb2 & pb3 will be treated as different grade pays for granting MACP. It means those officers in 5400 are never going to get 6600 gp instead theyare going to place them in 5400gp of pb3 with one increment only. This is really rediculous.

Sir, kindly refer to my note dated 25.9.2009 with regard to the anomaly created in letter F.No.26017/98/2008-Ad.IIA dated 16/9/2009 wherein the clause “subject to vigilance clearance” has been incorporated while granting GP of Rs.5400/- w.e.f.1/1/2006 to the Superintendents Group-B who have completed 4 years of service Sir I again repeat, neither this is promotion nor upgradation for ACP. Since it is a salary matter, there should not be such a clause of vigilance clearance. Is there such a clearance required while granting annual increment or dearness allowance etc. Please move this on all India level as this anomaly is going to cause harrasment to everyone under the CBEC. No such clearance was required in the letter issued by the Central Board of Direct Taxes.

    Your case is clear . How can they say you got two up-gradations. You were given ACP after 12 years only on condition that you will not be given financial benefit on promotion. Once you were not given any benefit on promotion how can they say you were give up-gradation. You ask them for fixation of pay on promotion as Supdt.(as per their interpretation). Therefore you are very much eligible for MACP on 1.9.08 without any ambiguity. You better put your claim in writing to the Commissioner, let them give in writing what ever they want to say. I have learnt from my well learnd friend( dealing with an Establishment) there are Finance Ministry order stating that Grade pay Rs.4600 i.e. If your pre-revised scales is more than Rs.5000 and you are drawing. The grade pay of Rs.4200,here is a good news for you viz admin staff members serving in lower formations In a reply given under RTI,The Ministry of Finance Deptt of Expdr. has clarified that the pre-revised scales Rs.5000-8000,5500-9000 and 6500-10500 have been granted identical revised pay Band of PB-2 (9300-34800) with grade pay of Rs.4600. It is means the grade pay of Supdt/Acctts/ssk and those UDCs who are granted 2nd ACP should be Rs.4600 instead of 4200 presently drawn by the Min of Finance Orders are with the concerned depatt.
    But I don’t have the releavent order so far, The Finance Ministry’s order that 4600 will be given in place of 4200 if your basic pay is more than Rs.5000..
    I retired from DRDO Lab as Supdt in the pre-revised pay scale of Rs.5500-9000 and my pre-revised basic pay was Rs.6900/- and retired on 31.06.2006. Request kindly send requisit guideline on my ID:[email protected].

Since, the pay has been refixed w.e.f. 01.01.2006 in respect of all employees on account of Sixth Pay Commission’s recommendations, whether the pay needs to be refixed on account of grant of Grade pay of Rs. 5400/- to Superintendents of Customs and Central Excise or not? Friends, please come forward for getting the condition waved from CBEC with regard to requirement of vigilance clearance for grant of Grade pay of Rs.5400/- to Superintendents Group B of Customs & Central Excise at par with the Circular/letter issued by the CBDT for the ITOs having 4 years of Service. If it is not done, I do’nt think there will be any benefit of this grade pay for the Superintendent of Cusotms and Central Excise.   25. Govt orders GP of Rs.4600 to cadres of 6500-10500 scale:This is apllicable only to the posts which were in the pre-revised scale of Rs.6500-10500 as on 1.1.2006.

    when people from ldc can rise to instpecors in 12 years (4 promotions) and people from inspectors are the same after 16 years what more can you expect from the people at the board. People who joined Examinar are promoted within 4 yrs as appraisers. Once vivekananda said the god who cannot give you bread how can he give you salvation. One who cannot give a single promotions in 16 years what more can they give.

  29. I think it was the pressure from various ministries to grant 4600 grade pay to those who were in 6500-10500 scale. But still the long pending demand of granting 4800 grade pay followed by 5400 grade pay after completion of 4 years to all those gazetted officers to bring at par with all those Group B gazetted officers who were in 6500-10500 scale has not yet been resolved which has caused severe resentment among the isolated Group B Gazetted Officers. Several CAT judgements have also come which have recommended to grant uniform Grade Pay of 4800 and 5400 to all Group B Officers, but it is very unfortunate that Mrs Madhumita Sukul, JS(Pers) and Mr Alok Saxena, Dir posted in DoE (Implementation Cell) are simply negating the issues inspite of the clearcut govt resolution and CAT directions. This clearly indicates their sadistic tendency. Hope the Govt will look into it and solve the demand of all Central Govt Group B Gazetted officers bringing at par with those of Section officers of CSS/CSSS.

  32. My DDO has not yet given the benefit of 5400 grade pay to superintendents of central excise even though the order was available in gconnect website. He feels that the said order is not available in any of the government websites. Kindly provide me with a link to any government website where the order is available.

    Despite my best efforts I could not locate the order dated 16.09.2009 giving benefit of Rs.5400 to sueprintndents of centra excise in finmin site. Admin is saying that the order is available in finmin. Kindly give the path.

      The order was available in finmin site from which we downloaded the same. Unfortunately being an old order it is not available presently. If your administration did not believe the copy of the said order available in Internet ask them to write to the Board to get a copy of the order

  34. At present I am placed in GP 5400/- after 2nd acp. Again I have been granted the 3rd acp in GP of 5400/- PB-3 instead of 6600/-. Please confirm whether it is right or incorrect.

      As per point 8.1 of MACP, grade pay of Rs.5400 in PB-2 and PB-3 are different. So, hierarchical upgradation from grade pay of Rs.5400 in PB-2 to grade pay of Rs.5400 in PB-3 is correct in your case

    2. i have been appointed as Accounts Officer in the Defence Accounts Department on 1-1-2002 and I have retired from service on 28-2-1004, in the scale 7500-250-12500. My pension has been fixed( taking the average pay of pay last drawn Rs. 10250) at Rs 5013/- Further Wef 1-1-2006 Pay scales have been revised. A system pay band and grade pay has been introdued (6th pay Commission) i.e., 9300-34500 and grade pay Pay of Rs 4800/-. Now the grade pay of Group B Officers have been revised from 4800 to 5400, will it apply in my case if so from which date.

Now my 2nd acp is due from 15th jluy 2008 after comleting 12 years of service under old acp scheme. Now new macp is implimented form 1st september, 2008. in my case wether i will get next higher scale i.e 10000-300-15000 under old scheme or some thing else under new scheme

  36. (i) Meaning of an officer is always officer, it never means technician or worker. Keeping SO’SB’ under Pay Band-II where technicians and workers are placed, shows demoralising SO’SB’. (ii) Basic and Pay Band hike above SO’F’ in extremly varying rates (no same percentage that of for Band-II & III) indicates stealing from Government Account openly. Whereever Promotion is concerned, it is on will of superiors and does not depend on work output.

    1. You are eligible for 2nd ACP as on 15th July 2008 as MACP takes effect only from 1.9.2008. You will be eligible for grade pay of 6600

The govt order upgrading the pay of Assistants and PAs was issued on 16 Nov 2009, but till now the concerned deptts could not be able to fix the pay of Assts/PAs due to dubious clarifications given by Mr Alok Saxena, Director (C) Min of Fin vide MoF, Deptt of Expenditure, IC UO No. 10/1/2009-IC dated 14-12-2009 to JS (AT&A), DOPT, New Delhi. Since in ibid order pay of Asstt/PAs has been suggested for fixattion as per the Illustration 4A meant for upgradation, it is not understood as to why he is misinterpreting the earlier order.

  41. Mr Alok Saxena, Dir, he do not know the difference between the Group B officer and Group C officer. So that he didn’t care about the Grade pay. I am working as Group B officer from the year 2006 onwards with high responsibility. But the Group C officers i.e. JE’s in my department are getting 5400 GP. In their case, the GP 4800 was skipped to 5400 GP from 4600. Now, the Junior Engineers are going through Air, taking allowance more than Group B officers. A gazetted Group B officers is not eligible for going through Air, but Group C officer is eligible as per the modern 6th pay commission. A Group C official can go and stay in 1500 rupees hotels, but a group B gazetted officer can go and stay only upto Rs. 500/- hotel. The grade should be fixed as per the Level of the officer. The scale of pay could be different but Grade pay must be in order i.e., from higher level to lower level official. Due to this differenciation, I am getting more shame in my department while going on tour. Because my low level officer is going to stay in 1500 ruppees hotel, and I am going to stay in 500 rupees hotel. Whether any country making these type of insultance to the officials?.

    1. I totally understand your problem this is really a disgusting senario. where an officer is deprived of certain facilities but since you are a Gazetted officer hence your position itself speaks of your status.

    1. If you are Direct recruit TGT in 5500-9000 scale you will get one MACP from 1/9/08-4600 GP and one will be due on 16/7/2012-4800 GP.

  43. I joined in 1975 as peventive officer. In 1996, I got promotion as Supderintendent.In 1999, when the ACP scheme was introduced I was given the ACP ie. after 24 years of service. As per the modified scheme, I should get 3rd ACP ie after 30 years of service Ie. in 2005. However 3r ACP is available only from 1-09-08. Whether I am eligible for grade pay of Rs.6600 from 1-09-2008 or ten years from the last ACP ie 2009. I am at present drawing a grade pay of Rs.5400/-

      As superinterndent you have been given 2nd ACP in the AC’s Scale 8000 and thus given GP 5400.
      As per clarification under MACP in point 7 you are eligible for 6600 GP as 3rd MACP w.e.f 01/09/2008. But the thing the said clarification is not categorically stated about the ACP holders of then AC scale 8000 you admin may object taking coverage under para 8.1 of original MACP that GP 5400 under PB2 and Pb3 are separate for MACP. Irony is that in the 6cpc fixation itself Fixing GP 5400 under PB3 to ACP holderes of then AC scale 8000 was not settled and a categorical reply is yet to be obtained from our CBEC. In such cases PAOs allowing only 5400 under PB2 then for MACP they will only allow 5400 unde PB3 as 3rd MACP as per para 8.1 of MACP OM. You may also refer the recent gconnect article on MACP Clarification. This is one another confusion. You please ask your Association to take up the issue and get categorical clarification from CBEC as to the fixation of 5400 under PB3 for the ACP holders(24 years) of the then AC scale of 8000, which is righteious one. Then only we can apply Clarification 7 for MACP and you will get 6600.

I am appointed as gr.II on 14.12.90 and promoted in the pay scale of Rs.6500-200-10500 on 31.12.1996 and after four years of regular service got notional benefit of scale Rs.8000-275-13500 w.we.f.31.12.2000. And w.e.f. 21.4.2010 they give me ad-hoc appointment of DANICS. My question is that how the pay fixation is to be made at present and whether I am eligible for 2nd MACP as I had given only one promotion. Presently I am getting b.p.19570+5400G.p.

    1. we are not able understand the term DANICS. But if you have been granted only one promotion in your total service of 20 years you will be eligible for 2nd MACP

  45. DANICS means Delhi and Andaman Nickobar  Iceland Civil Services. As per MACP orders issued by Ministry if one gets promotion in six years he should get IInd MACP in 16years instead of completion of 20 years whether it is correct?  please also clarify whether any increment is to be granted on ad-hoc promotion, if yes, whether we may give option that my increment of promotion will be given to me after giving my regular increment on 1.7.2010. pl. suggest me at the earliest. Thanks.

    1. Yes as per MACPS, one need not wait till 20th year for his 2nd MACP if he had completed 10 years of service in a grade.

      Also,as per MACPS read with CCS revised Pay rules, fixation could be deferred till you receive the increment. But you have to continue in old pay only till that period

  46. I had joined as Computer Operator in the Computer Centre, Gandhigram Rural University, Gandhigram (Fully funded by UGC) in November 1990. The hierarchy of the posts in the computer centre is Senior System Programmer /System Analyst, System Programmer / System Analyst, Computer Operator and Data entry operator. In 2003 one of the System programmer/System Analyst post (Group A, Scale of Pay: 8000-275-13500) was vacant and I was appointed in that post with necessary qualifications by DPC as per the Recruitment Rules of our University.
    At the time of Sixth pay implementation, the administration fixed me in the scale of Rs.9300-34800 with GP Rs.5400 (PB2) instead of Rs.15600-39100 with GP Rs.5400 (PB3). I request you to, please clarify me that to which scale of pay I am eligible for.

    1. We feel that your pay should have been fixed in Rs.15600-39100 with GP Rs.5400 (PB3) as this is entry grade for Group A Officers. We have also come across cases such as this where administration argues that the scale mentioned above is meant for only Group A direct recruits, and that officers who are promoted and receiving pre-revised group A scale of Rs.8000-13500 should be fixed in PB-2 5400 only. However, the administration has also taken a stand that officers who are in PB-2 5400 can be fixed in the grade pay of PB3 Rs.6400 when they are promoted or given MACP.

    I want to know according to 6th pay commission recommendatins that in case of annuals increment if increment is 410.10 then what is the rounding of 10.
    Wehter it is 410 or 420 and in case of 410.90 then what is the rounding of 10 in this case weteher it is 410 or 420

  50. Dear sir,
    Marine wing is field formation of CBEC,operating along vast coastal area of country,it possess its’ own departmental vessel which is used for anti-smuggling , rummaging and coastal security activities along with other security agencies.Like other department it consist of large numbers of employees of various catagories. But regret to inform you all the department is suffering from various pay anomalies,non-structuring of cadres and several marine issues.Though recently cadre restructuring of CBEC was done, by virtue of which several Gr. B and Gr. A officers got promotion. But being a part of CBEC this dept. remained neglected. So I request our benign authorities please look into the matter and do justice to this most neglected wing.

  51. I was promoted to the post of Systems Analyst Group A post in the pay scale of 8000-275-13500 on 30.06.2002 f. My office fixed my pay in 9300-34800 with grade pay 5400 on implementation of 6th pay commission. Is it correct?
    Under MACP , which grade pay will apply on 1.7.2012 as I have not received 3 promotions.

  52. I am in the pay scale of 7500-12000. But as per MIB has approved after 4 year we should get 5400 grade pay w. e. f completion. Now weather I should get one notional increment for fixation of pay.
