New Children Education Allowance Scheme
Wednesday, September 3, 2008
While we are very busy in calculating the our New Pay and Arrears, Govt has come up with another sweet surprise. The Sixth Pay Commission recommendations for enhancing the Children Education Allowances and merger of the same with Reimbursement of Tuition Fees has been accepted by the Govt as such.
As a result, all Central Government Employees are to be given a reasonable reimbursement of Educational Expenses unlike earlier restriction like reimbursement of only tuition fees of up to Rs. 40 per month.
Salient Features of reimbursement of children education allowance are :
- Children Education Allowance and Reimbursement of Tuition fees have been merged and the new scheme is known as Children Education Allowance Scheme.
- This scheme can be availed by Government employees upto a maximum of Two Children
- This is applicable for School going children only (nursery to 12th Std including 11th and 12th std conducted by Junior colleges)
- The Scheme has no nexus with the performance of the children in the class.
- The reimbursement is applicable for admission fees, laboratory fees, special fee charged for agriculture, music, electronics or any subject, fee charged for practical work, fees for use of any aid or appliance by the child, library fees, games/sports fees, fees for extra curricular activities, purchase of one set of text books and notebooks, two sets of uniforms and one set of school shoes.
- The annual ceiling for reimbursement of children education allowance is fixed at Rs.12,000/-.
- Hostel subsidy will be reimbursed upto maximum limit of Rs.3000/- per month per child. However, both hostel subsidy, and children education allowance can not be availed concurrently.
- The maximum limits in Children Education allowance and Hostel subsidy would be automatically raised by 25% every time the dearness allowance on the revise pay structure goes up by 50%.
- This scheme is effective from 01-09-08.
- Reimbursement of the children education allowance and Hostel subsidy would be made on production of original receipts self certified by the employee.

The relevant portion of income tax is given below which clearly stipulates any amount of payment which is in the nature of develpment ( vidyalaya vikas nidhi(vikas= development), sir in my opinion VVN is not allowable for claiming reimursement of tuition fees.
(13) Tuition fees, whether at the time of admission or thereafter, paid to any university, college, school or other educational institution situated in India, for the purpose of full-time education of any two children of the employee.
Full-time education includes any educational course offered by any university, college, school or other educational institution to a student who is enrolled full-time for the said course. It is also clarified that full-time education includes play-school activities, pre-nursery and nursery classes.
It is clarified that the amount allowable as tuition fees shall include any payment of fee to any university, college, school or other educational institution in India except the amount representing payment in the nature of development fees or donation or capitation fees or payment of similar nature.

dear madan lamture
As per Children Edu. assistance Rules your definition of Tuition fee is absolutely Right. Whereas as per Sec.80 C of IT Act Tuition fee means only Tuition Fee. If the School authorities gave the receipt for all other items like music/computer fees etc under one nomenclature Tuition Fee then it is okay. However, Whatever reimbursed to you under CEA should have to be included as income of that year

Children education allowance is for nursery to class XIIth. What is definition of nursery? Does it include pre-nursery, as in Delhi Public School pre-primary starts with pre-nursery followed by nursery, prep and then 1st while other institutions start with nursery followed by Lower KG, Upper KG and then 1st, taking exactly the same number of years before child reaches class 1st. However as per Govt. 6th pay commission, reimbursement in latter case is possible but same is not in case of DPS as it has termed its lowermost pre-primary class as pre-nursery – not specified in the 6th pay commission notification. Please clarify

children education allowance is taxable. It has to be shown as income. On the other hand tuition fees paid (up to 2 children) can be deducted under Section 80C. As you might be aware 80C deduction has a limit of Rs. 1 lakh. So if your regular savings such as GPF, LIC, PPF, ULIP etc exceeds Rs. 1 lakh there is no point in claiming exemption for tuition fees

In fact, re-imbursement is possible only if the institution is recognized by central / state govts. Obviously private coaching / tuition etc. cannot be reimbursed.

No further fees was paid under any head or in any manner. It was paid in June 2009. When I filed the application for the reimbursement I was told by the Accounts people that it should be filed only in Sep 09 (end of the quarter). I filed it in Sep 09. Now, they are saying that the entire amount will not be reimbursed in single payment and it will be divided into 4 equal portion that too will be reimbursed at the end of the each quarter (i.e)Sep,Dec,Mar, June. I want to know whether I am eligible for single payment immediately or have to wait upto the year end. Is there any rule provision for the above issue, kindly give it in your reply.

CEA will be applicable to two children at any point of time and it is not related to number of children the employee has been blessed with. In your case, you can apply for CEA for your two younger children once the eldest enters into college

I submitted bills for CEA but the accounts people have not cleared the payment as he has mentioned that it is not reimbursible as the payments have been made before the notification ie 2.9.2008. i had deposited the fee on 1.4.2008 and purchased the books also. Please clarify whether these are payable on pro rata basis or not

If the amount paid is meant for whole year i.e 2008-09 not withstanding the fact that the fee is paid in advance, you are entitled to claim the fees relates to the period from 1.9.2008 to end of academic year in 2009. These are practical issues involved which can not be covered in the CEA order. The persons implementing the rule should see the intention of the govt

My office asked to me only one elder child cea can be reimburseble only. The GOI restricted to children from 01.01.1999. My all children burn before 01.01.1999. Please inform that to me immidite about my CEA claim.

“The GOI restricted to children from 01.01.1999.” — This is your observation. We could not make out anything from this. In general, there is no linkage between birth date and CEA. CEA could be availed for payment of school fees, school items such as shoes, uniforms, text books etc and other admissible fees for first two children, who are studying from Kinder garden to 12th std

Is term fee comes under CEA? Can i claim term fee charged by school in CEA?
Mostly all schools are charging term fee in each half(term), twice in a year. Tution fee can be claim in CEA, other such fees can be claimed for CEA. Why term fee is not claimed as CEA?

dear patel
Term fee paid is also eligible under CEA. For the details, what constitutes the term fee of your school, you just give a copy of your school’s fee brochure/fees schedules etc generally nowadays given by schools, so that your admin confirms that whether the term fee is included with Donation/building fund which are in eligible . In any case but for the donations term fee is eligible for CEA

It is not possible. As per OM CEA is available only for the two eldest children. Please go to circular corner of Gconnect for the original CEA.

Sir,
Reimbursement of Children Education Allowance (CEA) is admissible for three children if they are born before 31.12.1987 and for two children born after 31.12.1987. I have two daughters born in 1979 and 1984 (before 31.12.1987) and one adopted girl child born in 1994. It may kindly be clarified whether I am entitled to reimbuse CEA for the third child born in 1994.

We are of the opinion that there is no bar in claiming CEA when the child is studying in the same class again. Also, you need not deduct the amount already received by you.

Thank you very much. But little more help is requested. I am also of the same opinion as you but my office says that one cannot claim. They say that one can claim CEA for the same class if the child fails and not in the case such as mine. I would appreciate if you could intimate the rule no or memo No to support the opinion. With due respect: Venu

For your situation, that is in the case of children studying in the same class again, there is no specific clarification issued by govt yet. Since there is no bar for this situation in the original order your office ought to have allowed this. We request you to post this matter in the GConnect discussion board where the other members can also share their views on this aspect

Clothing prescribed by the school is referred to as uniform (for example trouser, shirt, tie, belt, batch etc). Schools would normally supply or prescribe to buy these clothing in two numbers for alternate use. As such we feel the order for CEA should be read in common parlance

Please refer to the original order for children education allowance. It says Tuition Fee Means Tuition fee, Admission fee, lab fee, special fee charged for agriculture, electronics, music or any other subject, Fee charged for practical work under the programme of work experience, fee paid for the use of any aid or appliance by the child, library fee, games/sports fee and fee for extra curricular activities.

Sir, I had claimed CEA. PAO, NSI, Ministry of Finance, Nagpur has raised objection for Socks, drawing copy, practical book, Misc. fee (which is for Lib.fee, Laboratory fee). INspite of my clarification and point out the OM , He repeatedly refuse the bill by raising objection that your reply is not satifactory. What is to be done? INspite of clear instruction if some PAO is refusing the bill what is to be done ? Please guide me.

CEA includes reimbursement of for books and note books, uniforms . Your claim for socks (if for uniform of your child) & drawing note etc are well within the common nomenclature of book, note books and uniforms. For misc fee -you may get a certificate/evidence from your school detailing what fees are comprising the “misc fee”. Any how, all administrators/auditors should have to apply some rational logic in finalizing CEA claims without detrimental to the Govt’s intention. At the same time claimants are also having the responsibility to get such unquestionable Receipts/evidences from the School authorities/books shops for gaining the full fruits of the scheme.

This is a superficial audit. Government has provided the procedure for reimbursement through the CEA order as follows (Para 2)
“2. In order to ensure that Government servants have no difficulty in claiming
reimbursement, the procedure under this Scheme is being kept simple.
Reimbursement should henceforth be made on the submission of original receipts on
the basis of self-certification by the Government servant.”
So there are only two conditions 1. submission of original receipt 2.self certification by the Government Servant.
If you have satisfied these two conditions you can very well represent against the rejection of claim.

I’ve come accross that some office while reimbursing uniforms reimburse two sets each of summer (blue colour-2 sets, white which is for once in a week – 2 sets) and also for winter (gray colour- 2 sets with coat, sweaters etc), some other offices only admit two set of unforms for the whole year wheter it is for summer or winter or one each for both.
Please clarify.

My office told my to submit it after completion of one quarter of school functioning i.e as per them in September 2010 only I have to submit my application for reimbursement. Please clarify. I have paid annual fee in April, 2010 and Purchased books, uniform and shoes in July. In July I have submitted my application for reimbursement but advised me to submit in September, 2010.

In the order it says “One set Text Book, Note Book, 2 sets of Uniform……..” From this it is clear that we can claim reimbursement for 1 set Text Book and 2 sets of Uniform. But what about Note Books ? At the start of the academic year one cannot predict how many Note Books one may need. Moreover Kendriya Vidyalayas insist thin Notes Books for children as part of reducing the weight the children carry. In that case can we submit claim for additional Note Books throughout the year ?
